  • @cdimmm you do in Australia if you are traveling anywhere by car (driver). If not a license you must have valid photographic ID (public transport)

  • @cdimmm Licence not needed to "travel", you need a licence to operate dangerous machinery (cars) on government property (city, state and interstate highways). You can walk, cycle or ride a horse without any need of ID or licence. And if there was a long enough private road you wouldn't need a driver's licence for that, just the road owner's permission.

    That is how this doesn't go against the constitutional prohibition of any sort of "internal passport".

  • @ElectricTN Well, to a degree, you're right. But they can "target" anybody they want ~ they have to have probable cause to stop them. If you're not doing anything wrong, they will *probably* leave you alone. Face it ~ to effectively fight real crime, cops "want" to stop and search EVERYBODY. But the Constitution limits them to stopping only those who are doing something wrong. Take the hint!

  • In Britain if you get stopped and you park legally ie: in a place where you could walk away and leave your car, when you stop and get out of the car if you LOCK the car they cannot then search your car as it is locked and they would need a search warrant. they will ofc ask you if they can look in the car but you just have to say politely ''I will not give you permission'', they can ask why and you have no obligation to provide an answer to that question.

  • @PublicVIDE0 Incorrect. If you consent to a search the cop can pull apart the car completely. If theres something like a laptop in there and they break it, its your problem. Plus, its your right. Whether or not you have nothing to hide is irrelivant. A search is a pain in the ass for you, and its much easier to avoid it. If you dont excercise your rights they will eventually begin to disappear...

  • The way I see it, local cops have specifically tracked me down on personal time to tell me they have always wanted to pull me over to see my cars. Why not consent to a search? It almost always gets you off the hook for whatever they stopped you for in the first place. Speeding? Stopped? Asked for a search? Chances are, no matter how dangerous your driving was, if the search comes up clean and you're clearly capable of driving home, he'll let you go, no charges.

    In practice they can get away with it unless you have a witness. My experience with traffic court is that the judge accepts the cop's word unless you have a witness.

    Conversely, a lawyer relative told me that it is legal to lie to a cop, except for giving false identity. So lying about what's in the car =legal. Lying about your name =criminal.

    well...yeah...not having a witness of your own is a big problem. Cops in my town are starting to use these cameras that are attached to their heads. I think these are a great idea....to protect both parties. A dash cam does you no good at all when the conversation is taking place in front of the vehicle and sound can't be picked up that far.

  • @badpanda84 -- you're wrong, and it does work (i know for a fact, from experience). to answer your question, they ask to search precisely because they CAN'T search without either consent, a warrant, or probable cause (such as smelling marijuana smoke). they need to trick people into giving them consent to gain access, which is why they always word their request in a tricky way.

    I think the law is the same here in the states but people do not know. I had a friend tell a officer that he does not concent to his bike bags being searched and he was arested for some bull charge, I think it was interfering with an investigation or something like that and his bike bags were searched any way. He did not have anything but he will still brought on charges for the inferfering thing.

    He went to court and lost so its going to happen no mater what.

  • most all the cops in my county all have dogs, all they have to do is walk up to the outside of your car and claim the dog scents something and they then have legal reasonable suspicion to search your auto.

    My grandfather was a police officer for 38 years and is one of the gentlest and nicest people I've ever met. If you have had bad experiences with officers thats fine (so have I) but I would appreciate if you at least considered the fact that some officers are decent, hard-working good people.

  • I was pulled over by a cop a while ago. He asked, "you don't have any guns or weapons I should know about do you?". If I had one of my guns with me should I have said something or just lied? Was this a trick question? I though about saying "none that you need to know about" but I just said no.

  • yes you should tell him and hopefully you took out all the rounds in the chamber and put it in your trunk with the ammo in a separate bag. Ask him if you can show your proof of registration. If he asks you what you use it for tell him the truth (self defense, hunting, etc). It would be bad if he for some reason ended up searching your car (if he was an asshole) and found the gun. you could spend the night in jail for lying to an officer in a very extreme case

  • @anon034117 Yes. I guess the truth is alway best. However in SC you don't have to have your gun registered or carry something like that (proof of ownership/ gov. permission) with you. You do have to have it unloaded and "two moves away" ie. in glove box, trunk, etc. But if he were just pulling me a common traffic violation why does he "need to know"? Many people around here carry especially during hunting season.

  • @anon034117: Depends on the state. No registration needed in Texas, only that one be 'traveling'. What I have done is say nothing unless asked.

    The two times I was asked, I simply kept my hands in plain site and replied something like "Yes I am armed. It is in the xxx and is loaded. What would you like me to do?" In both instances the officers asked me to procure my documents, then had me exit the vehicle.

    It was no big deal.

    Safety first. The officers want to go home later, and so do I.

  • i said no to a cop before and they still searched cause i look suspicious and for them thats probable cause, i lost the case and now have a felony. so the cops will do anything believe me or maybe my lawyer just didnt do enough

  • I dont' believe most cops are good. All my life I have been a good citizen and never been in any trouble but a few driving tickets. Same with my family but we have been robbed in our business and not a damn thing was done despite the fact I knew who did the robbery. I have been followed in my own private drive from home by a police officer who later was found to be sexually assaulting women and was fired. I think about 40 percent of all police are good people and the rest are rough.

That having been said, I am not but do look hispanic and unfortunately driving home late at night ( shiftwork, NOT partying ) I have been followed, I have been pulled over for nothing other than "looking" suspicious ( my best guess ), and I have gone through the entire " Mind if I have a look / nothing to worry if nothing to hide " bullshit. I've even been sober tested for the hell of it. So I would have to firmly disagree with your statement.

  • @Brownton4 Cops do this all the time and if you did some research you would know. Cops are humans too which means they aren't invincible from making mistakes and doing bad things. Atrocities happen to people by over-zealous police officers constantly. I respect the work they do, I respect what they are trying to accomplish, but the fact remains that all too often they can't help but mess up or go too far and when that happens, it pays to know your rights so you can defend yourself from abuse.

  • @Brownton4 It depends where you get pulled over.Growing up in a suburb right outside of New Orleans, cops break every rule in the book pulling people over and using "probable cause" to search for drugs. If you get pulled over in the city where crime is high they follow the law. They are not interested in illegally searching you vehicle hoping for a simple possesion arrest, they have much more important things to deal with.

  • @snakeeyes3883 you probably need to do a little bit of research. The supreme court has confirmed that police do not have to have a search warrant to search a vehicle. Like Nagamangos indicated probable cause will suffice if there is no consent.

  • @MrDebo1906: Officers still need the same probable cause and a list of items or people being searched for that they would need for a judge to issue a warrant.

    The only real difference is that the step of obtaining a warrant is moved from before to after the physical search.

A bad cop can ruin your life, and it's often difficult to tell the difference between a good and a bad one. Never take anything for granted. Be careful.

  • @badpanda84: Last I heard, 3 states think it's unlawful to record officers, and 2 of those are on the track to fix this oversight.

    Your second point is just your opinion, unless you have independent proof. For a single data point against, I have never had a recording device taken away from me by an officer.

  • Driver DID NOT forfeit his 4th amendment right. If officer wishes to search, absent probable cause or incident to lawful arrest, he must have consent. Supreme Court ruled, driver cannot be perceived by the officer to provide consent for a search until he has been told he is free to leave. The officer here is detaining the driver and consent has NOT been given nor implied, regardless of the officer’s perception. This search would be tossed out of court faster than a live hand grenade!
