He actually KILLED someone and violated his parole using cocaine, but got no jail time. So when you put the two side by side and you can clearly see there is an inconsistency and discrimination. How much he got during that robbery is irrelevant (victims were still threatened). During probation, he tested positive for drug use and his sentence changed (as punishment for now 2nd offense, the drugs) to life with possibility of parole. Governer should not have pardoned those offenses. Parole board, after review of his behavior, should have decided release.

He got, with the possibility of parole after 20 years (those sentence from September 1st 1993 onwards got the chance of parole after serving 30 years so he got off lucky), but his sentence ws commuted. If we're talking about compassion etc Judge Brown endorsed the commutation, he was already elected out of office by this point, and if he had wanted to could have vetoed the commutation and requird Brown to serve his whole sentence.

If Judge Dean's sentence was illegal the Court of Appeals would have overturned it and quahsed the conviction on the grounds it was illegal.

He was not on probation, the Judge used a DEFERRED AJUDICATION- that means you are not technically convicted, its akin to probation but it means if you violate the terms of you DA you can be sentenced for the original crime. You can't give someone life for possession of marijuana, its only a misdemeanor, he was sentenced for armed robbery- all that happened was the Judge deferred sentencing him for it.
You really need to read up on this case before you make such comments.

Fact you could not have given the kid 3 years as aggravated robbery under Texas law is a FIRST DEGREE FELONY, the sentencing range is 5 years to 99 years or life.

You can't prove Judge Dean was a 'racist faggot' (oh the irony, you're criticisng the Judge for being racist and yet being prejudiced yourself by using a homophobic slur). The media like simple black and white (literally in this case) situations, Judge Dean gave whitey probation and blacky life in prison, the fact is throughout his career he probably sentenced thousands of people, Black and White, so these two isolated incidents don't prove he was racist.
If Brown had wanted to he could have opted not to agree to deferred ajudication and just be sentenced for the armed robbery, its doubtful he would have received more than 10 years and at that time it was only necessary to serve 1/3rd of the sentence on a 3g offence so he would have been out in less than 3 years with good behaviour.
If he had behaved himself and served his 10 years of deferred ajudication this would never have happened to him.

No its not excessive, here in the UK we have a notoriously liberal justice system but armed robbers often spend 8 or 9 years+ in prison. Granted, for something such as Brown's crime you would probably receive 18 months for the armed robbery (plus 5 years for the illegal firearm as it would be here).
I'm 17 myself and have always been inclined to make myself fully aware of the law, if you don't you have only yourself to blame, ignorance is no excuse.

He actually KILLED someone and violated his parole using cocaine, but got no jail time. So when you put the two side by side and you can clearly see there is an inconsistency and discrimination. His release makes me angry as well. Tyrone Brown was originally sentenced to probation after committing an aggravated armed robbery. How much he got during that robbery is irrelevant (victims were still threatened). During probation, he tested positive for drug use and his sentence changed (as punishment for now 2nd offense, the drugs) to life with possibility of parole. Governer should not have pardoned those offenses. Parole board, after review of his behavior, should have decided release.

Tyrone Brown did not serve one day in prison for the aggravated armed robbery. His weak punishment for that was ten years of probation. During that probation, he committed a second offense (tested positive for drug use). His sentence was only then increased to life with possibility of parole. His release at that point was dependant on ongoing reviews by a parole board.

Note that his pardon is "conditional" If he uses marijuana again, he must be returned to prison to complete his sentence. Murder and cocain is one thing. Apparently you CAN be sentenced to life. Granted, he was on probation, but when you violate your piss test while on probation, they can't give you more time in prison than whatever the remainder of the length of your probation was. So, anything in excess of 10 years on here is, in fact, punishment that has nothing to do with armed robbery. 7 years for a joint. Longer without this news story.

HE DIDN'T GET 17 YEARS! He got, with the possibility of parole after 20 years (those sentence from September 1st 1993 onwards got the chance of parole after serving 30 years so he got off lucky), but his sentence ws commuted. If we're talking about compassion etc Judge Brown endorsed the commutation, he was already elected out of office by this point, and if he had wanted to could have vetoed the commutation and requird Brown to serve his whole sentence.

He was not given 10 years, he was given 10 years deferred ajudication, that basically means, "Behave yourself for 10 years, but if you fuck up I can re-sentence you for the original offence".
If Judge Dean's sentence was illegal the Court of Appeals would have overturned it and quahsed the conviction on the grounds it was illegal.

He didn't walk back and give his victim the money, he gave him back his wallet when he asked for it, that hardly makes everything okay. The money WAS recovered later that night, it was only $2 anyway, but it was recovered when the police tracked down Brown and his accomplice.

I don't know how old Brown was, if he was 16 at the time then he would have had to have been certified to stand trial as an adult and that would indicate the prosector felt the case was very serious and the juvenile justice system could not adequately reflect how serious his crime was in sentencing.

Obviously the terms of his probation where contingent apon him not breaking any more Laws. Robbery is a Felony. A Joint is a class C misdemeanor. Firstly he should of never been arrested for a joint. That arrest lead to his Probation officer violating him. That Violation did not have to go to court. That was the P.O.'s choice. then The Judge gave him 17 years.Learn the system yo

He was not on probation, the Judge used a DEFERRED AJUDICATION- that means you are not technically convicted, its akin to probation but it means if you violate the terms of you DA you can be sentenced for the original crime. You can't give someone life for possession of marijuana, its only a misdemeanor, he was sentenced for armed robbery- all that happened was the Judge deferred sentencing him for it.
You really need to read up on this case before you make such comments.

Nor am I from Texas but I have read up on their laws. Plus this is the point, the first time round the Judge actually gave him a chance not to even have a criminal conviction on his record and he blew that chance. How many chances do you get? Some judges would have thrown the book at him immediately and given him life.

@theporksicle : your just being hard headed. I never said Brown shouldnt have been sent to jail. No one is saying that. what people are saying is that the sentence was incredible. He should have done the minimum 5 years. & that is still excessive but Texas laws are the worse in the entire Unites States. In Ny that kid would have done 18 months. Or even given another chance if he took a Drug addiction & anger management class. As his lawyer these are the things I would have pushed for.

Everyone's views are coloured by their own experiences, clearly you feel some animosity toward the justice system, I don't know whether it was to do with the felonies you were said to have committed which prevented you from becoming a lawyer and I don't know you & don't wish to speculate across the internet. Likewise my view is that kids like him are the reason kids like me are looked upon as potential criminals by old ladies, the police etc

You can't prove Judge Dean was a 'racist faggot' (oh the irony, you're criticisng the Judge for being racist and yet being prejudiced yourself by using a homophobic slur). The media like simple black and white (literally in this case) situations, Judge Dean gave whitey probation and blacky life in prison, the fact is throughout his career he probably sentenced thousands of people, Black and White, so these two isolated incidents don't prove he was racist.

If Brown had wanted to he could have opted not to agree to deferred ajudication and just be sentenced for the armed robbery, its doubtful he would have received more than 10 years and at that time it was only necessary to serve 1/3rd of the sentence on a 3g offence so he would have been out in less than 3 years with good behaviour.
If he had behaved himself and served his 10 years of deferred ajudication this would never have happened to him.

@theporksicle :NO, if his punk ass probation officer wouldnt of violated him, and that fag ass judge wouldnt of abused the law he wouldnt of done 17 years. That was excessive. Why are acting as if his sentence wasnt excessive. 7 years, 10 years, still excessive. He robbed some one for 2 bucks, & caught with a joint? If it wasnt a bullshit sentence then why was it over turned? He was just young & poor so he couldnt afford an appeal or smart enough to figure it out. He finally got justice.

True, if his probation officer hadn't given him a violation if the Judge hadn't given him life, if if if etc the one if you neglected to mention was IF Brown had not been stupid enough to use an illegal drug while he was on deferred ajudication this would not have happened. I don't think Brown denied he committed the armed robbery nor that he used marijuana, so what's he moaning about?

@theporksicle : No 1 saying Brown was in the right. You are missing the point. His sentence was excessive for his crime. Either robbery or the joint. First off a Life sentence for robbery is asinine by any measure & 17 years for a joint even dumber. He should have done a few years for breaking his probation stipulations & given a chance to go to school,educate himself & given work release.Help the young kid out not kill his future.People like U never get it cause U dont see humanity you see LAw

No its not excessive, here in the UK we have a notoriously liberal justice system but armed robbers often spend 8 or 9 years+ in prison. Granted, for something such as Brown's crime you would probably receive 18 months for the armed robbery (plus 5 years for the illegal firearm as it would be here).
I'm 17 myself and have always been inclined to make myself fully aware of the law, if you don't you have only yourself to blame, ignorance is no excuse.

@theporksicle : now I get it. you live in the UK. You need to live in America to understand this kind of sentencing injustice that happens to Black youth. Also you are 17 explains why you dont see the kid being 17 as being a child. I am old enough to be your father. So I see the world a bit different. & dont reply with no age doesnt matter. cause it does. It matters in all aspects of life. No ignorance is no excuse, but that doesnt excuse judges from abusing power.
