I don't see why I was marked down, but what I said is perfectly true. If it's exactly $75k, the court or the opposing party(more likely) will have a successful 12B1 objection. Yeah the plaintiff can re-file if they can find one penny more in damages, but doesn't change the fact that until that happens there's no subject matter jurisdiction. If there's no SMJ, the court MUST dismiss according to the rules.
