Youtube's not letting me respond for some reason. some OS's and webapps don't phone home in the manner that was described. Sure, ISP's could view the data, but in most cases it's not going to tell them much. Even web requests that use browser settings can be faked as a major option in most current mobile web browsers. Unless you're like actually downloading windows updates or something, mobile carriers wouldn't be the wiser.

@survivorevil I cant explain how TCP/IP works in 500 characters but The data sent from the phone is different then the data sent from the computer. Your computer will make attempts to do updates, special dns look ups, etc that the phone wont do. Simply looking for little things like that and cross linking it with the database of who hasn't paid for teathering...makes it pretty simple.

@therealandycook not necessarily. updates can be disabled, and different OS's communicate differently. also, the phone tethering app should be smart enough to do NAT and block out local multicast messages.

@silivrenion the only time you wouldn't be able to view the traffic would be if it was VPN, and then they would notice you were using a VPN and just say you were tethering right then.
