  • The justices already understand what each advocate is going to argue, and it's not that they're showboating during orals, although many probably do, but that the oral arguments facilitate the need all people have: to be heard and recognized.

  • Perhaps if the justices allowed the guy to answer the justices questions, then the justices would be able to understand what the guy is arguing.

  • Ha! Excellent point, but good luck getting the justices to sit still, keep their mouths shut, and listen to the arguments of the advocates. It just goes to show that by the time oral argument rolls around, most justices have already made their minds up about how they are going to vote on a case - either from reading the arguments in the written briefs, discussing the case with their clerks, or both. Oral argument is pretty much just showboat time for the justices...and the advocates, of course.

  • @danberkeley they already know what he's going to say cause they submit briefs. Oral arguments is a chance to probe and tell the advocate where they are not persuaded and have problems with. So its not necessary questions, its arguing back and forth with the judges
