a great way to avoid traffic tickets is to have a schedule of fees and a few copies of a proper civil servents questionaire. Inform the officer (perferably on video) what your rate is for being pulled over, then let the officer know he is required by federal law to fill the questionaire out right away. Most often they'll jump right back in their cars and drive away.
I hate these scum lawyers making money off hopeless victims of the state. It's your word against the cops. The judge represents the state. Argueing with a cop whether you speeding or not is like argueing with the Mafia about whether you have to pay them protection money.
Why don't you argue standing in these cases? Or conflict of interest? After all, the plaintiff is the state and the judge works for the state. Get the ticket thrown out altogether. We have a sovereign right to drive, and if you study new york law (or any other state for that matter), you'd see that there is no law requiring a license to operate a private automobile for the purpose of travel. Only commercial.
True, this is only stuff that we can argue pro se since the BAR attorney pledges allegiance first ot the court, then community, then defendant. The BAR is a foreign entity, interestingly enough, our original 13th amendment barred anybody with titles (in attorneys cases, esquires) from office AND citizenship. This was removed in the "new" corporate Constitution around the Reconstruction Era. You can actually find this amendment in old Constitutions from the early 1800s in some libraries.
It's a process, and you have to know what you're doing. First thing you do is request that the trial be recorded, second you demand that all facts in the trial be tried under I believe it's 7th amendment common law, come in with a certified copy of the judge's oath of office to force him to follow his oath and deposit it as evidence, along with a whole stack of case law supporting your positions. Then, when you're found guilty, file an appeal w/ no new evidence allowed. Bingo.
I wish we had such traffic law in Poland. When you get a ticket in Poland and in many European Union Countries you have to pay this using money transfers. You don't need to see the court.
I am just interested in fees of such attorneys :D
The funniest thing I have ever seen was when I was in traffic court here in Florida. The Traffic Magistrate was surprised to see that only an attorney stood up when a 17 year old boys name was called. The Traffic Magistrate asked who he was. The attorney explained that he was hired to defend the individual that received the speeding ticket. The Traffic Magistrate quickly stated. "Great! That is all I need to know. I find your client guilty and placing him on a curfew and levying a fine."
Let me get this straight. People are going to actually retain a lawyer like this one for lets say $200 an hour to fight off a $50 dollar ticket in court?
Unlike most lawyers, we charge one flat fee to handle your case. No hourly rates or per appearances charges. Therefore, there are no surprises for our clients.
There are a very few moving violation tickets that are $50. Sounds like a parking ticket. In any event, give me a call if you want for a free consultation. Matthew Weiss 888 Red Light
