Gadd is definitely not outta time. The part that may sound out of time to you is the triplet he does on beat 4 of the fill before doing the big crash on the 1.
Actually, i finally realised that the musicians, including gadd are playing it right, but James kinda slows a bit on that fill and makes it sound a bit odd.
James Taylor has always played and sang behind the beat. When his first records were released, he had Russ Kunkel on the drums, who purposely drew out the fills to where he barely hit the downbeat on time. It sure seems intentional to me.
