According to Osha you are supposed to honk the horn of your forklift before you back up. Also people on the job site should remain alert at all times to the sounds around them. Even though the guy driving the forklift had headphones on the guy who got his foot crushed didn't and should have heard the audible warning sound the forklift was backing up.

Overall it was a fault on both parties.
