The dude wasnt in county lockup.. thats tax dollars... And the guy represented himself.. no public defender or tax dollars there.

  • @meeio442 Actually, in a court operating under the constitution of the United States, the state must prove "injury", i.e., who suffered damage, was endangered, or rights were violated by this man's actions? The officer lodged the only complaint and testified he was not harmed nor felt himself at risk. He perjured himself to boot. Case dismissed. Do not say "I know my rights!".... exercise them. Peace.

  • Your better argument would have been that you were not traveling at a rate of speed was unreasonable under the circumstances. Also, there was no evidence that the trooper was qualified to operate that radar or how he tested it was operating properly.

  • You have to attack the actual radar and just because someone is trained in it's use does not make him/her and expert. There are many questions I would have asked concerning this officers use of the radar "unit" For instance..just because someone might know how to turn on and play an X-Box, doesn't mean it can't malfunction. So the question becomes weather or not the cop fixes his own radar gun and how he can tell weather or not it's broken. Company x-prts won't come because of privacy prot laws.

It contained no legal defense(s) whatsoever. It was a social commentary that had no value whatsoever. Good job admitting guilt.

    I drive around small towns all the time. And they purposely have speed limit signs which make no sense other than to generate revenue.

    It would be the judgment call of the official if you molested the butterflies or not. I go camping all the time and do know a lot of the rules. Picking up a few sticks is not allowed this is made very clear to everyone.

    But there is no way I would know if a certain plant or lizard is not to be molested. By molested they mean disturbed, killed, chased away etc etc etc.

    You say the signs are everywhere, sure in a big city they are. But the same does not apply to small towns who intentionally place signs where they are easily overlooked.

    IE you are driving 70 MPH on the main interstate in West Texas it is 200 miles from ANYWHERE suddenly you go over a hill and on the other side it says 50 MPH and the cop is right there with a radar gun. GUESS WHAT???? You just got busted.

  • @CSATexan I grew up in a small town so I know what you mean. 1,100 people. I could see the officer being reasonable in this instance. However, traveling at that same rate of speed after the missing the sign because you were too busy talking on your phone is a different story.

Which is where the judge comes in... and even then that person is still a human being. I was surprised to hear the verdict on the vid response to this. Thanks for the responses!   • @CSATexan Ha. I really don't know. I never read it in HS and I had the time to read it when I was overseas in Iraq so I figured I'd take the time to make myself less ignorant. It really is a depressing book and I guess at the time I really could relate to it. The line "I hunt people in this hat." killed me. I have a sick sense of humor I guess. I still love the book despite the criticism it gets from a lot of younger readers today.

This was standard procedure for a police officer to write this ticket and as a notice to him to slow the fuck down... I would be happy to know officers are looking out for the safety of all.   • I find it hard to believe you won although good try. Supposedly they have to see you speed before using the gun. I KNOW they do not. If this cop had rear mounted radar and was sitting in his car facing the direction you were driving, how could he see you speeding as opposed to just looking at the radar and seeing a number? How did he measure your speed by looking at you pass other cars, did he know how fast the other cars were traveling? Did he use the gun on them for reference?

  • By the way - I am a champion for the cause here in Massachusetts - ask the state and local police, ahhhh my old friend, the Registry of Motor Vehicles, how they feel about me - took me a while to get it right, but now it's safe to say i have ZERO fear of saying what it was I arrived to say, sometimes that alone - catches them off guard.

In order to be damaged you must have a just claim, a just claim is being able to prove loss or harm. How was the state, county, or city respectivly damaged? Where is their loss? If a human being is hurt by neg traveling then, and only then, is there a claim, by the injured party only, not a gov. Actuality precedes potentiality.

If cops didnt write those tickets, WAY more people would speed (knowing theres no penalty). If someone who is speeding because they know theres no penalty when normally they wouldnt knowing the cops could catch them, and they kill someone. Then the "claim" does that dead person no good does it?

  • @shmoopify If it were truly a horable crime then should there not be a more fitting punishment, like 100 hours comunity service? Why is there always money invluved? If Bill Gates gets a $1000 ticket its no big deal if a poor person gets a $1000 ticket it destroys them, whereas if Gates and the poor person have to spend 100 hours picking up trash on the road they are both equally punished are they not? Tickets are in the budget of most states and desired. Its a conflict of interest.

  • @shmoopify Correct. Having said that, a private insurance company could refuse to insure unsafe drivers w/o having any money involved for a noninjured party like the "state". A neighbor hood could post a speed limit on its streets and then bill the insurance co for the damages should a car (plate #) go terring ass threw a posted area. There is a better way then using the force of gov. In general I agree w/ you about being safe, but a better contract is needed then just demanding money.

The primary purpose of ticket writing is to track the driving habits of bad drivers and when necessary, weed them out (ie...suspensions, or revoking the license). Insurance companies would go broke with your idea. Besides, what if no driver got insurance then? Or for that matter even bothered to go get a license...How would any of that be regulated/enforced?

  • Speed limits were made to try and prevent accidents. He says that if he caused any damage he would be happy to pay for it. Why not drive the speed limit, or close to it, and avoid accidents in the first place??? I hope his friends are all wealthy but choose to dress down, because if they seriously injure someone, and they don't have insurance, they are fucked. Finally, if there was no legitimate reason for the low speed limit, he would have mentioned it.

  • Insurance companies statistics show drivers who typically drive from 5-10 mph over the speed limit are safe drivers,but the irony is the same insurance companies donate these $900-$2000 radar guns to our local municipal police stations which are told to increase public safety quote on quote.Get radar detectors do some research and look out at the end of the month....the courts cannot handle a million claims on how they used a radar detector which alerted them 1/2 mile ahead,legal in 48 states.

  • @BenjaminPipic In his statement, he was not denying the fact he was speeding. In fact, he admitted it several times. His defense was built around the justification of his crime: (keeping up with traffic; the speed limit should be higher in that area; etc) He, in fact, did commit the crime, but he has taken the Libertarian view point to such an extreme as to be in defiance of all government and laws. He has offered no reason as to why he doesn't want to pay except his simple definace of the law.

    There are circumstances. I once had to make an aggressive left turn to change lanes to avoid a car accident on the highway. I did not use a turn signals. Technically, I could've gotten a ticket for not using my turn signals. That ticket wouldn't stand in court though.

  • @BenjaminPipic That is obviously a situation that would have to be evaluated on its own merits. Unless Mr. Ryder could offer specific justification for his speed that would void his intent to break the law, the ticket is valid. And his attempts to fight the ticket undermine the Libertarian viewpoint. We are for small government and state rights over federal government. Not anti-laws and police, anarchy and rejection of valid and existing laws that the state has put forth.

    I am a Libertarian, I'm not against laws, I am against bad laws. If someone breaks a law that's not right, it doesn't bother me personally.

  • @BenjaminPipic The only reason the case was thrown out is the officer mis-remembered the situation concerning this incident. Speed limits are not 'bad laws'. & just because u are against them doesn't make breaking them wrong. We have proper avenues for disgruntled citizens to voice complaints & room for change to happen. Change can't happen when we have citizens such as this guy refusing to abide by the law which has been established. He can't pick & choose which ones he will decide to follow.

    Some speed limits are bad laws, certainly. Explain this...On I-95 in my part, the speed limit is 55MPH. To get off at an exit, the speed limit is 25MPH, in some parts I've seen it 15MPH because of a slope. So I could be getting off I-95 onto either exit well, I'm screwed; I can't drive 25 on I-95 because I'll get hit and I can't drive 55 on the exit because that's over the speed limit. So I technically just drove twice the speed limit. There's many traffic laws that are garbage.

  • @BenjaminPipic I don't see how you are screwed when the posted speed limit around a narrow turn is 25 or 15 mph. For the speed limit to be that low on an exit, the degree of a turn has to be past a certain point, which will make any speed exceeding that a dangerous speed. Otherwise, the speed will usually be 45 or 35 on an exit.

    Also, I challenge you to start looking into ways you can help change laws, or vote people in who will represent you the way you want to be.

    Most people drive well over the speed limit on those exits, so the turns aren't that narrow.

    I know how the law process works. The only problem is, for every letter that I may write to a senator about some law, theres thousands of dollars in donations and gifts coming from some lobbyist to keep that law the way it is. And the constituents always get re-elected in this part. Oh and I cant run for any office myself because I don't have connections and 2-3 million dollars lying around.

    Actually we do not. In the US, the distance between the ordinary citizen and the power structure is very large. We have ways of expressing complaints, such as in writing or protest, but we have no ways of seeing that those complaints are taken seriously.

  • @BenjaminPipic Like it or not, we are a nation of laws. And as citizens, we must obey those laws. The constitution allows for state and federal laws, like it or not. Don't take your Libertarian view to such an extreme to think the founders meant for there to be no established law, or government. Libertarians often go to such an extreme to be anti any kind of law, and to use their belief to fit their life style of anti-authority. Speed limits don't impose on your personal liberty or freedom.

  • That's right. Once you've entered a plea, you've begged the court for its assistance, and you're under its jurisdiction. Even before that, if you signed a ticket and not made it clear that your signing was under protest, and you have not agreed to waive any rights by signing - you've entered into contract with the court. After that, you're pretty much at the mercy of the court.

He should not have given consent to anything.
