A Law can only be enforced if it is constitutional. You can argue your case all the way to the supreme court. The problem is most people plea to lower courts and wave their rights to a fair trial. Something that seems to be overlooked is this: While the police are obliged (right) to inform you of your right to remain silent, this is ONLY upon your arrest. You ALWAYS have that right, of course (it's part of your Freedom of Speech) but the cops may do a lot of talking and questioning before they ever get to the "arrest" part of the game. Don't wait until you're arrested to shut up! Just don't talk to cops. Ever.

The EU did a study recently (maybe 2 years ago?) on the effect of cannabis on driver safety with the idea of proving it to be dangerous so as to force Holland to criminalize it. To their surprise, there was NO net increase in danger. Apparently the "paranoia" effect prompted slower speeds and increased caution, which counterbalanced the slower reaction times. Personally I do NOT drive while high. These results surprised me, but this was a large, well-funded government study.
