This reminds me of my very first deposition I ever took. The opposing counsel challenged me to a slug fight in the parking lot. Welcome to Los Angeles.
I have never seen anything like this in a depo. In my jurisdiction Kouri would be getting sanctions and costs againsthim and a rocket from the judge. Just absurd.
even though the attorney is a total asshole and a torturous bastard trying to make life miserable for everyone in the room, there were some wife-beating questions asked.
Maybe he is just really passionate? I have seen what happens in court and lawyers DO TRY to manipulate the truth. Maybe the guy just is sick and tired of bull shit? Maybe he really hates this guy? We don't know. All I know is that I would love a lawyer that this, but one that is is a bit less boisterous.
This attorney is out of control. I work for attorneys for 23 years and have had only a few that get out of line, but nothing like this. He should be disbarred.
@Nightsforever One person is not a representative of ALL American lawyers. This lawyer is acting like a jerk and the court will sanction him for instructing the witness not to answer.
sounds like a lawyer i would want to help me.he made some good points because your answer can always come back to haunt your ass.so if you don't answer then you cant be found guilty for perjury.
The problem the first lawyer had is he kept arguing with the a-hole instead of just asking the question.
The instructions not to answer in the second deposition were bogus and if the other lawyer was any good he got Kouri sanctioned. You can only instruct not to answer if the question calls for privileged information.
@chewbaca1989 - no you don't want that guy as your attorney. Any judge that sees this is going to fine both the attorney and the client he represents. You'd just have to waste another day doing the same depositions and It also prejudices the judge against you and your attorney. Any client that sees his attorney act in this manner should immediately fire him and report him to the state bar.
I'm an attorney. This is not how 99.99% of depositions go. Kouri is an ass, and (another) embarrassment to what I hold dear. I've been in over 1,000 depositions in my career... this is not how they go. On another note, if you choose to believe what is posted on any internet site is how real life works, you need to think and dig deeper. Mass media will kill your brain. Seek facts, not snippets of "reality". THINK. QUESTION. THINK AGAIN.
@Robert111 I've been practicing for 20 years. I've been in more than 140 trials. For your GED brain, I'll keep this math simple. Over 20 years I'd only have to average a little less than 1 deposition a week to get to 1,000 by now. (Hint: there are 52 weeks in a year). I have 3 tomorrow. Bag.
@Loiyaboy Why the hell would you be having a deposition every week? ...Unless in 20-years you never managed to crawl up of the floor of a large law firm where they have you pretty much just handle the depos in all their cases! OMG, that's you isn't it!!! OMG. Most lawyers would have just as soon shot themselves in the head. NOTE: What you see in this video wouldn't fly for a sec. in California. After the first couple unanswered questions I would stop and file a motion to compell/get my fees.
@Robert111 I try cases. Its called litigation. I couldn't stand to work for a large law firm, corporate interests and insurance companies are not who I want to represent. So I work for myself. I do just fine. I guess the only things you and I will agree on is that this wouldn't fly in any jurisdiction and I would also file a motion as well as an ethical complaint. I grow weary of this childishness and that I joined in it. Best of luck to you.
@Loiyaboy If you're involved in litigation working for yourself, you DO NOT attend depos an average of once a week (and certainly not over the last 20-years!). LOL. Just come clean and admit you were wildly exaggerating as is your habit. And don't you try to get up on your high-horse and escape your own folly. You turn up the heat in the kitchen and then complain when it gets to hot for you, eh? Is this also your habit, sir? I would suspect that it is. Best of luck to you with that then.
@Robert111 Are you that miserable that you would call out someone on something that they do for a living. Just shut up. You are a troll. You attack people from anonymity and by doing so prove that you are a baby girl. Good bye.
@jeste4187 No, they don't do that for a living. I'm calling someone out for lying, not what they do for a living. Obviously you are just a troll trying to stir up an argument. Bye.
@Robert111 I'm a troll for calling you out? LOL, That is a typical troll move. What evidence do you even have that this guy is lying?? NONE. A troll likes to make up things out of thin air to illicit an argument with someone else, which is what you have attempted to do, you idiot. LOL, read a book.
@keltik21912 Yes, they do. It depends on the jurisdiction (state or federal court, etc) as to exactly what sanctions are available, but for the most part they are pretty much the same. In my jurisdiction, this juvenile behavior would be punished severely.
@Loiyaboy What does it mean when Kouri says "no foundation"? I am a little lost as to what that means. Does it mean that the quesion comes out of nowhere and the facts or implied circumstances of the case do not provide foundation for a question like that to be asked? Like I said, I am a little lost on that one.
@keltik21912 Well, I don't want to ever guess what Kouri thinks... but essentially that's what a lack of foundation is. Don't rely on this video as an example of anything other than what an asshole sounds like.
@Loiyaboy So, you're telling me that I guessed correctly as to what "no foundation" means? Not bad for a non-Lawyer, right? So, say I was to sue my ex-wife for a change in visitation or custody, can I instruct my attorney that I want a deposition and would I have the right to be there?
@keltik21912 Yes. You can ask for a deposition so long as it is for a legitimate purpose and not just to harass. A party always has the right to attend any deposition in their case.
I believe your comment qualifies under one of your suggestions: And I quote, "On another note, if you choose to believe what is posted on any internet site is how real life works, you need to think and dig deeper."

What's the difference between a lawyer and garbage? Garbage at least gets thrown out.

This is why the entire justice system stinks. The poor don't get this help, while criminals who can afford it, do.
All lawyers should be functionaries who facilitate the process of law, or killed.
