Pedophiles, exhibitionist etc. would be protected under this law and under 18USC2A any religion that preaches against homosexuality (Jewish, Christian, Islam), the preacher could be charged as a principal. Are you familiar with the terms, mitigating and aggravating circumstances? What about first degree and second degree etc.. crimes? Not all crimes are treated the same anyways, nor should they be in any rational system of justice.

What this does is protect any person who is victimized because of their sexual orientation (30 different types). So for instance if a pedo was to be battered by someone the batterer would be charged with a hate crime because the amendment to specify what sexual orientations are protected was not passed. It's TOO vague.
The bill has to do with the circumstances of a crime, so it does have to do with the difference in the motives of a crime, just as aggravating circumstances do in sentencing. And, because we live in a nation of laws, people are not supposed to be battering pedos. If a child is being attacked, you can still use force to stop the attack. You just cannot hunt down local sex offenders vigilante style, and attack them. Big difference.

I think that the whole point of the hate crimes bill is to protect everybody from being targeted for racial, political, sexual, or religous affiliations. This applies to Christians as well as jews. Homosexuals as well as heterosexuals. Republicans as well as Democrats.
Then repeal the hate crimes laws protecting Christians and exclude religion from the Civil Rights act of 1964 because Christians are using their protections as offensive weapons and that either has to be addressed legally or extra-legally.

BTW, no one is falsely imprisoned in foster care. Final clause of the bill:
"Nothing in this Act, or the amendments made by this Act, shall be construed to prohibit any expressive conduct protected from legal prohibition by, or any activities protected by, the Constitution."
That means the scenario he describes where the pastor gets arrested for a hate crime committed by a congregant because of a statement he made regarding homosexuality is not applicable under this law.

Although to be fair, crime is never that one-dimensional and intent of the perpetrator is constantly a factor. This is how we, for example, distinguish between homicides (manslaughter, murder, etc.) and even the degree of that crime (1st degree/2nd degree, voluntary/involuntary, etc.). Criminal trespass is elevated to burglary with mere intent (burglary is breaking and entering with the intent to commit a felony therein) and no actual theft is even necessary.

The only reason I might be for this is to draw a paralell to the killings of black men in the south in the 30s-60's who killers regularly got off by all white southern juries.

I live in Chicago.
Last year we led all cities with over 500 murders.
The good news is that few of these murders fall in to the categories of "hate crimes" - ie attacking people because of bias of sexual orientation, Muslim immigrant status etc.
So since these murders weren't "hate crimes", I guess we should call them "love crimes" and the relatives of the victims should feel good that Chicago thugs have PC views of gay marriage/muslim immigration, transgender something or other.

Go back to the speech in the video. The explanation about the flasher and the woman that hits him with a purse in response. The flasher performs a midemeanor, but the lady performs a federel felony via a not too unreasonable act of batting the guy with a purse. In this fictional scenario, the outcome is viably likely, yet has little to do with the First Amendment.

I agree that she's stupid, but I disagree with the law because EVERY crime is a hate crime regardless of the motive. This bill sets a dangerous precedent of punishing thoughts. Pedophiles, exhibitionist etc. would be protected under this law and under 18USC2A any religion that preaches against homosexuality (Jewish, Christian, Islam), the preacher could be charged as a principal. We need fairness and this bill just moves us away from our core principals of equality.

This law does not punish thoughts, but actions. We are all free to hate whomever we choose, but targeting people for being a Christian or Muslim, etc. and violating their civil rights is not what a free and just society allows. Preachers can still preach against homosexuality, they just cannot incite their flocks to commit crimes against them.

They should ALL pay the EQUAL consequence of their action regardless of their thoughts towards the victim. In other words treat ALL criminals the same. If they murder then charge them with murder, if steal charge them with theft, if they torture charge them with torture. Stop categorizing people.

Yes I understand those terms and that's not the point of my argument. In fact this bill doesn't have anything to do with those terms. What this does is protect any person who is victimized because of their sexual orientation (30 different types). So for instance if a pedo was to be battered by someone the batterer would be charged with a hate crime because the amendment to specify what sexual orientations are protected was not passed. It's TOO vague.

The bill has to do with the circumstances of a crime, so it does have to do with the difference in the motives of a crime, just as aggravating circumstances do in sentencing. And, because we live in a nation of laws, people are not supposed to be battering pedos. If a child is being attacked, you can still use force to stop the attack. You just cannot hunt down local sex offenders vigilante style, and attack them. Big difference.

That is not correct. Again, we are going to mitigating circumstances. If a man robs a store for money, his actions are motivated by acquiring money, There is a big difference between hate and indifference to anothers well being. Where in the bill does it say that a parent of a victim will be charged with a hate crime? They would be charged with assault because justice is to be meted out by the state, and not private citizens. That has always been the case.

I understand your logic defining hate. But I still wish they would've specified "sexual orientation". A judge must abide by the law and if the law doesn't specify what sexual orientations are protected, then it must be taken as plain definition which includes pedophilia, exhibitionism, etc. Which could result in an assault on a pedo to be a hate crime. They should've passed the amendment to specify sexual orientation.
Bottom line: its just too vague and vague laws are not good ones.

BTW, no one is falsely imprisoned in foster care. It isn't a prison sentence for one thing, and second, the reasons why children are place in care of the state has nothing to do with discrimination or persecution. There would be no need for this law if homosexuals weren't being killed and discriminated against. It's not about creating a special class. The class was already created by people who hate us so much. We have this protection here in Canada, and from what I can tell, it works just fine.
