Uh, the creators of this game did not make this outfit for Kooh. It is a mod. And quite frankly? People should stop freaking out about it, because there's plenty of moral panic to go around in the real world. There's no harm being done by looking at pixels. It's not even photorealistic.

Charging someone under the PROTECT Act for video game art such as this wouldn't get very far because I doubt it would fail the Miller test in most rational areas of the nation. No sex is taking place here, and there's no nudity.

Besides, if it was taken to the US Supreme Court it would likely be overturned as unconstitutional.

Pornography is protected by the first amendment, here in America. Bush banned Lolis (What we would agree this is) in 2004. In 2006 the Supreme Court over ruled this act and made lolis legal again AS LONG as it did not Realistically represent child pornography (3D and what not)

Technically, if a work is viewed as obscene based on "community standards" and thus fails the miller test in that area, you can still be charged for it. If you had the resources to keep it in the courts, it may very well be overturned by the Supreme Court, but that's debatable because they would also take community standards into consideration.

TL;DR Becuase of BS community standards, what's illegal in Alabama doesn't get a second look in San Francisco.
