Feres also protects lawyers from legal malpractice. I was threatened by Army lawyer CPT Matthew Fitzgerald to do something against regulations resulting in losing over $50,000. When I asked the top lawyer (now LTG Dana Chipman) for help, they appointed Fitzgerald’s previous boss/friend to investigate. I filed the same complaint with Fitzgerald’s state bar proving he lied more than 10 times. All thrown out of federal court due to Feres despite evidence. Fitzgerald got promoted to Major.
Chuck died at 31 yrs. old and i was 20. it's been six years this December but i still find it so hard to talk about it with my soon to be six year old. She has so many questions as to why she doesnt have a daddy like the other kids in her class. I miss him so much and i wish the Army medical team wouldnt have made this mistake. Damn the Feres Doctrine. Damn those so called Doctors at Fort Huachuca! I just wish my little girl had her dad.
I lost my husband Chuck Kilmon to stage 4 melanoma cancer on December 16th just four days after our little girl Charlene Kilmon was born.
Chuck was mis diagnosed my an Army medical doctor at Fort Huachuca Arizona when he was 22 yrs. old. By the time the military properly diangosed him he was at stage 4 metastatic melanoma and was given six months. He fought for many years. I met him in 2001 and what a beautiful human being he was. I'ts a shame neither he nor his family could be justified.
My condolences. I was recently introduced to this "fine" piece of legislation. My situation pales in comparison, but I thought I would share. I was hit by a car, found not at fault, and they use my insurance to pay the Tricare bill because of the Feres Doctrine???? Why not the other military members insurance? I was always aware of RHIP, but I did not think that the AF would provide those privleges at the cost of another's well being.
My son Michael Fremer was killed at Fort Polk, La on 2/13/08 because of Army Negligence. The Army can not be held accountable because of the Feres Doctrine. This law needs to be changed. Why is the Army exempt from being held accountable for Negligence? Our young men and woman are risking their lives. This is how our country treats the soldiers and the families? The Feres Doctrine needs to be overturned!
