This man was justified in defending himself initially. However, once the person was down and no longer presented a threat you do NOT have the right to walk by the unconscious person not once but twice, retrieve a new gun and stand over that person to fire 5 additional times. If you make the decision to arm yourself lawfully I think that decision requires you to hold yourself to a HIGHER STANDARD of conduct than the criminals. Of course, a carefully pre-screened jury found the pharmacist guilty, of first degree murder no less. I have considerable reservations about this outcome. Yes, the extra 5 rounds may seem harsh. But, as far as I'm concerned, if the perpetrator who just tried to rob me at gunpoint is still alive in my home or store, he still poses a serious threat. I am not safe at that point, which I should have a right to be in my own home or business. If it requires an extra 5 rounds to achieve that, so be it.

But there has been some stuff come up that might get the case thrown out. Mainly because the victim would have died from his wounds anyway even if he wasn't shot 5 more times. Dude was totally in the wrong, main reason for it is simple, when he went back for the 2nd gun, he could have continued to stay out of harms way. When he was outside the store he could have stayed there. He had *zero* reason to go back, get the 2nd gun, and then shoot the guy while he wasn't a threat. At that point he wasn't in danger from, and he actually placed himself into danger by going back to "finish off" the downed robber. It was clearly a revenge thing then.

The first shots were Ok. Chasing the guy out of the store was NOT OK. When the guy left the store, the threat was over. Coming back in and using a "New York Reload" to do the guy on the floor was murder plain and simple. I dont agree. A wounded armed criminal is still dangerous. In the heat of the moment he probably assumed the wounded to be armed. He had the option of finding out by being shot, or double tapping the punk just to make sure. In Iraq we have similar problems. I think you are right on the money there are limitations to self defense and that is why the DA is charging him. Because he crossed the line by going back and shooting him. I think if he would have just held the other gun on him and did so until the police arrived then he would be a free man and there wouldn't be anything to worry about. But I think there is a good chance that he will get some jail time out of this.

You are of course correct, but the law also clearly states that it is an offence to enter someones private property and point a gun at them. When this occurs, the owner has every right to reply with deadly force, the owner is not bound by the same rubrik as say, a police officer would be.

I know what I would do in that situation and if that kid was down bleeding from his head and not moving I would call the cops and hold a gun on him. I had someone break into my house and I shot them just inside my front door and I thought they were dead but they were just unconscious and I held my gun on him until the cops got there. Yeah I could have killed him but he was no longer a threat. He is now serving 15 years for B&E and posession of a fire arm and narcotics.

However, once the person was down and no longer presented a threat you do NOT have the right to walk by the unconscious person not once but twice, retrieve a new gun and stand over that person to fire 5 additional times. Of course, a carefully pre-screened jury found the pharmacist guilty, of first degree murder no less. I have considerable reservations about this outcome. Yes, the extra 5 rounds may seem harsh. But, as far as I'm concerned, if the perpetrator who just tried to rob me at gunpoint is still alive in my home or store, he still poses a serious threat. I am not safe at that point, which I should have a right to be in my own home or business. If it requires an extra 5 rounds to achieve that, so be it.

But there has been some stuff come up that might get the case thrown out. Mainly because the victim would have died from his wounds anyway even if he wasn't shot 5 more times. When he was outside the store he could have stayed there. He had *zero* reason to go back, get the 2nd gun, and then shoot the guy while he wasn't a threat. At that point he wasn't in danger from, and he actually placed himself into danger by going back to "finish off" the downed robber. It was clearly a revenge thing then.

The guy was no longer a threat at all when he is on the floor bleeding from a gunshot wound to the head. He still hasn't gone to trial on this yet but they are going for first degree murder.

His trial is coming up in September and he has quite a battle in front of him. If you read the self defense law you can see that he did go too far. I live in OKC and being oklahoma there is a good chance the jury will let him go. Honestly lol.

The first shots were Ok. Chasing the guy out of the store was NOT OK. When the guy left the store, the threat was over. Coming back in and using a "New York Reload" to do the guy on the floor was murder plain and simple. You simply CAN NOT continue to apply deadly force once the threat of death or great bodily harm has ended.

I dont agree. A wounded armed criminal is still dangerous. In the heat of the moment he probably assumed the wounded to be armed. He had the option of finding out by being shot, or double tapping the punk just to make sure. In Iraq we have similar problems. The wounded are the most dangerous, yet international society thinks them victims on need of second chances.
His actions were right, one must shoot to kill in mortal combat. Fairness and mercy just doesnt come into play.

No there was another camera angle that they couldn't show because it was too graphic. But the guy was shot in the head and bleeding. He was no longer a threat and he was unarmed. What would have been so bad about him holding the gun on him while he calls the cops? Granted I don't care the kid is dead he shouldn't have been there, had he been in school he would still be alive.

@jackbelias the kid was unconcious though. sure, shot in the leg or stomach wounded and they still pose a threat, but the kid was unconscious, on the ground and dying. i encourage people who use guns in self defence, but getting a new weapon in order to shoot the kid in the stomach (if he wanted to put the kid out of his misery he would have shot the head or heart) five times? that is murder, this guy is going to jail.

In this case, im neutral. hes not a little boy if hes robbing a store with a real gun that can take lives. He could have killed the pharmacist. Ersland woke up that day and thought to himself "Just another ordinary day making pills." He had no intention putting someones life at risk. The 2 boys on the other hand... woke up that day with the intention of robbing a pharmacy and putting peoples lives on the line. Ok, oklahoma DOES have a law that states you can use deadly force to protect yourself if the suspect is still a threat. No WHAT was threatening about a 16 yr old on the floor bleeding from his head and unconscious? Absolutely nothing, I think he was right to go and get the other gun and then just hold the gun on him until the police got there but to go over and shoot him 5 more times at point blank range in the chest? Once this guy was down the threat ended, taking the second shooting from self defense to murder. The suspect with the gun yes~! The un-armed suspect though he had no visible weapon, is a questionable circumstance as the store owner did not know if he had a gun hidden.
But, after the fact of shooting him once and him going down; that was enough.

Furthermore he could almost have killed innocent bystanders by firing outside.

But either way that is a risk they take when they decide to break the law. But I do agree with you that the pharmacist crossed the line when he went back and shot him on the floor like that.

I think you are right on the money there are limitations to self defense and that is why the DA is charging him. Because he crossed the line by going back and shooting him. I think if he would have just held the other gun on him and did so until the police arrived then he would be a free man and there wouldn't be anything to worry about. But I think there is a good chance that he will get some jail time out of this.

You are of course correct, but the law also clearly states that it is an offence to enter someones private property and point a gun at them. When this occurs, the owner has every right to reply with deadly force, the owner is not bound by the same rubrik as say, a police officer would be.
A sad situation all round.

yep I blame the parents as well. According to the news this was a good kid honor roll and shit but he made a BAD decision to go along with his buddy. They also discovered that he was involved in a gang so the parents didn't know everything. I know people are limited due to income but why live in a gang neighborhood. They walk outside see gangs, guns, and drugs what do you expect them to do? They see that as the norm. People just need to stay away from it and that would help alot.

I know what I would do in that situation and if that kid was down bleeding from his head and not moving I would call the cops and hold a gun on him. I had someone break into my house and I shot them just inside my front door and I thought they were dead but they were just unconscious and I held my gun on him until the cops got there. Yeah I could have killed him but he was no longer a threat. He is now serving 15 years for B&E and posession of a fire arm and narcotics.
