Mr. Jones you have Posse Comitatus only half right, Title 18 USC only applies to troops in federal service under Title 10 USC. The Guard acting under Title 32 USC is not held to Posse Comitatus as it is at the time a branch of state law enforcement.

Troops take an Oath to Support Uphold and defend the Constitution of the United States from all enemies, foreign and Domestic and they have the Right to Disobey any order thats UNLAWFUL. Violation of the Posse Comitatus act is a prime example of that. When confronting soldiers on the street, be sure and explain that to them. Better yet, ask to speak with their Commander.
