Something similar happened to me a while back with my video's being embedded even when I ticked the box when I uploaded it saying no embedding. When I contacted the person in question, he said that the video was public and therefore he had the right to put it on his channel and that YouTube had given him a list of usernames and videos he is allowed to use!
