Someone I know said that when they signed their contract for their ARM that it specifically said "if you sign this you authorize the lender to resell your mortage" or something like that. If that's the case I wonder if those people have the right to fight a foreclosure. My guess would be no.
@brown55061 We all have that agreement for the most part. When they sell it to the next company they have to do the chain of title properly. If they did, then they would have standing to foreclose. I guess another issue too is that these companies are servicing the loan and not the actual lenders themselves. that's another avenue of attack for the defense.
