The Hyde Amendment will also not prevent this bill (HR 3962) from providing federal funding of abortion-on-demand. The Hyde Amendment applies only to funds appropriated through the annual Health and Human Services (HHS) appropriations bill. Therefore, the Hyde Amendment does not apply to the federal dollars used to establish and operate the abortion-funding component of the "public option". Likewise, it doe not apply to any abortion premium subsidy program that would be created by HR 3962.

Enrollees would be required to pay into abortion coverage. Abortionists would send bills for abortions to the federal government, and they would receive payment checks from a federal (public funds) account. This is direct federal government funding of abortion.
