From Micheli's report: Micheli did not want to look at the doctored police log book so he bases the time the police arrived (12:35 pm) at the apartment on the word of an officer that also later apparently lied in court about entering the crime scene. Witnesses testified he entered the crime scene. Also everyone present knew her throat had been cut and it was necessary to uncover her head to see that her throat was cut. The court never took issue with this lie.

Judge Micheli refers to a phone call made at 11:50 am and concludes the police knew of the UK phone because of this phone call. How could he draw that conclusion? The phone was not found until after 11:50 am.

Italian appeals do not allow new evidence in trial. The evidence allowed in for the second appeal is a very, very, very small portion that convicted her.
Also, Guede's second appeal was summarily rejected. Not good for Knox and Sollecito because the court found all three guilty.

If knox is capable of posting less than clean and moral stuff on her facebook which I think no one(not even her parents) expects, then I think she is capable of doing anything. There needs to be someone like a judge on US juries to help jurors make an logical intelligent decision free of rumor, media, or celebrity.
That would be great, except in Italy, it is just the opposite of what you are saying. Jurors can read papers, watch tv, give interviews, be swayed by public opinion and gossip during the trial, as in this case. Even if she is guilty, the trial was a disgrace.
Let me clarify...Media reports may be true or not. The jurors hear the testimony firsthand from the horses mouth, unfiltered by the press so they are in the best position to discount hearsay from facts or testimony and not be influenced by media innuendo or conjecture --provided that professional judges are on the jury to help the untrained jurors think critically and logically to discount such rumors or non essential info.
The investigation from the beginning was contaminated, that we know is true (and not uncommon in Italy) and even the investigators admit to this. Now, the U.S. system of justice is clearly the best on paper, but unfortunately, in practice it only favors the famous and the wealthy. And in America, the prosecutors only care about winning, even if it means putting someone who is innocent behind bars. Jury by peers is still the best, there is no political aspect involved or prejudice from an expert.

No murder weapon? No motive? Meredith's room would have been filled with dozens of bloody footprints, handprints and DNA of three people, not one, if the prosecutor's theory is true. People "wrongly accused of crimes" that are "freed after many years" is something that only happens in America, Britain and (maybe) in other third world countries. There isn't one innocent person in Continental European jails. In Italy, trials take so long because before putting a person in jail they need to make sure he/she is really guilty. And they have so many rights and guarantees for the defendant that even with a minimal doubt a criminal is set free.

I am not hired by anyone. The biggest mistake the Knox clan ever made is to critizise the Italian criminal system, which is well known all over the world to be the most fair and balanced in the entire universe. Ask any professor of comparative criminal law and procedure.

From Micheli's report: Micheli did not want to look at the doctored police log book so he bases the time the police arrived (12:35 pm) at the apartment on the word of an officer that also later apparently lied in court about entering the crime scene. Witnesses testified he entered the crime scene. Also everyone present knew her throat had been cut and it was necessary to uncover her head to see that her throat was cut. The court never took issue with this lie.

From judge Micheli's report and the Motivation document: Meredith UK phone was ringing when it was found at 12:07 pm in a garden by Ms Lanna's daughter. Judge Micheli refers to a phone call made at 11:50 am and concludes the police knew of the UK phone because of this phone call. How could he draw that conclusion? The phone was not found until after 11:50 am.

@fretbuzz59 Thanks for the article; although it's nearly a year old and they just ruled on what evidence is allowed for the first appeal. She got the DNA on the knife to be reexamined but no crime scene.
Italian appeals do not allow new evidence in trial. The evidence allowed in for the second appeal is a very, very, very small portion that convicted her.
Also, Guede's second appeal was summarily rejected. Not good for Knox and Sollecito because the court found all three guilty.

If knox is capable of posting less than clean and moral stuff on her facebook which I think no one(not even her parents) expects, then I think she is capable of doing anything. US lawyers are paid to win, not to get to the truth. What the lawyer above didn't mention is why there is a judge in the Italian jury, to avoid media influence, see the truth better, and be aware of the techniques of lawyers. EU courts are better. More procedural. US will have more OJs and Robert Blake cases when juries are fooled by lawyers. There needs to be someone like a judge on US juries to help jurors make an logical intelligent decision free of rumor, media, or celebrity.

That would be great, except in Italy, it is just the opposite of what you are saying. Jurors can read papers, watch tv, give interviews, be swayed by public opinion and gossip during the trial, as in this case. Even if she is guilty, the trial was a disgrace.

Let me clarify...Media reports may be true or not. The jurors hear the testimony firsthand from the horses mouth, unfiltered by the press so they are in the best position to discount hearsay from facts or testimony and not be influenced by media innuendo or conjecture --provided that professional judges are on the jury to help the untrained jurors think critically and logically to discount such rumors or non essential info.

The investigation from the beginning was contaminated, that we know is true (and not uncommon in Italy) and even the investigators admit to this. Now, the U.S. system of justice is clearly the best on paper, but unfortunately, in practice it only favors the famous and the wealthy. And in America, the prosecutors only care about winning, even if it means putting someone who is innocent behind bars. Jury by peers is still the best, there is no political aspect involved or prejudice from an expert.
