After investing in the 4th Ed. book set (and loving it), I hadn't planned on upgrading to the next edition (as I also generally refuse every new ed of D&D until it becomes obsolete). However, Dave's description of the combat system has actually piqued my interest and now I believe I will purchase at least a couple of the books to check it out. Thanks.
No. It uses a spell point system in which you can cast any spell you know, provided you've got enough spell points remaining. it does have a spell memorization mechanic where memorized spells cost less spell points to case than unmemorized spells, though.
