Just because a bill may reinforce what the Constitution says doesn't make it unconstitutional. In fact, even if it goes AGAINST the Constitution, sometimes it remains until it is challenged and struck down. Two examples of this was the 2000 ban against gay marriage in California that was determined to be unconstitutional 8 years later. Other examples were the bans against interracial marriage that were only struck down in 1967.
