It does not look like the officer made any deliberate attempt to "slam" the man into the glass. It was his hand or arm that made contact well before the body; whether he punched the glass or was just off balance is hard to tell. If I had to say one way or the other, it looked to me like the officer was slowing down and the man was too drunk to restrain his momentum and ended up off-balance. Unfortunate, but I see nothing to suggest the officer had any intent to cause this accident.

I can not say from the angle of this video that the cop tossed the guy head first into the glass. The suspect seems very unstable on his feet. But even from this angle, I also can not see how the officer received a concussion.

"Disturbing the Peace". How is there any peace to begin with when we all have an argument, every minute of everyday, and those same arguments lead to situations like this or worse?

Worked walked rode BART in Oakland 30 years .When there were someone like that bi-polar drunk whatever. What worked for me is observe get out of their way. Most of the time they just want to yell for a while. Many times I just said hi can I get by.I would of moved to another BART train like I did many times. ( I am White)

The guy with the supposed bi-polar said, "Who wants to play king of the mountain". Does that invoke fear (is he assaulting anyone) or is he just screaming (disturbing the peace)?
The witness tells him, "You should get off the train". The cop says, "Please get off the train". He says that while grabbing (battery and or simple assault) the supposed bi-polar guy. The cop then slams him through a window (aggravated assault/battery depending on your state). You're right, they are both wrong.

he could've slammed him on the ground and cuffed him. The cop lost his temper and went too far. fu#k the brother hood of blue. The pigs need to weed out the bad cops. These rogue cops make all cops look bad and theres no getting around that fact.

I mean, I were at a bar and through an asshole through a window and the asshole slit his throat on the glass and died, I'd be tried for murder. This guy didn't even touch the cop. The cop got the cut on his arm because he chose to put the man through a window. It's a no brainer. Cause and affect; that charge, with a good lawyer, should be nol pros.

The glass was an accident. The cop was in the right. This story shouldn't be an issue. The only issue is how we can monitor those with Bi -Polar and two, Bart needs to remove all that fucking glass and change it to the hard plastic shit, like AIX stated.

The cop was not out of line...he may have used a bit too much force, but for everyone's safety, better a little too much than not enough. The drunk/crazy guy was menacing innocent people. Too bad if he's mentally ill; he can't threaten people..what if he'd pulled out a gun & started shooting?

The glass breaking was an accident, thus there's no room for assault charges. Clearly the man was shocked after the glass broke and was in fear for his life at that point, so no room for resisting arrest.
My question is would this officer handle the situation in a different manner if the drunk man was white?

I'm gonna have to say that the cop was in the right here. If you think about it, the cop didn't toss the perp against the glass that hard. I bet the cop didn't expect the glass to break! AND... the perps head didn't go through the glass it was his elbow! The fact here is that if the cop intentionally attempted to slam the perp hard enough to break the glass then he would be abusing his power... but I see the cop gently tossing the perp against the glass. Look how slow it went down!!!

I agree that a person behaving like that should be taken off of the train, but he didn't have to get his head slammed through glass like that when he didn't actually harm anyone.

I find it weird that the cop gets all of the treatment but it was the Bi polar man that went through the window. And what bothers me is that the state allows bi polar people to walk around like that because there a danger to themselves.
