That may be the case, however, it is very clearly stated in the Bill of Rights that anything not clearly stated as something that can be dealt with Federally has to be dealt with by states.
Maybe Alabama won't legalize gay marriage. But that doesn't matter. It's a church-sanctioned ceremony. Churches do it, not states.

It's a church sanctioned ceremony with *legal bearing.* You get a tax write off for it. It determines inheritance and visitation privileges and a bunch of other things. So yes, it clearly does matter, because a prohibition on it is denying a legal benefit to a percentage of the population.
