Canada became legally sovereign in 1931. A sovereign country can choose to do as it pleases with its various institutions, within limits set by the Constitution. The limits in 1931 allowed Canada to leave "the old machinery" of amendment temporarily with the UK. Amendment power is different from legislative power, which Canada possessed domestically in full measure for self-government under the Constitutional formula at s. 91, "Peace, Order and Good Government".
Moreover, the same Constitutional limits in 1931 prohibited Trudeau in 1982 from adding a Charter to the Constitution which drastically altered the nature of government & powers in Canada, as well as illegally reducing & limiting the rights guaranteed to us under Magna Carta. The Charter was and is an illegal amendment and has never been JUDICIALLY reviewed in a competent COURT; the advisory or opinion jurisdictions of the Supreme Court & appellate courts are NON-judicial with no force of law.
Yes, that's right; because Canada, Australia, Papua New Guinea, Jamaica, Britain, St. Lucia, & the rest share one person as their respective monarch doesn't mean any is dependant on the other; each has it's own unique monarchy, just the same individual as monarch. The poster to whom I was responding inferred that Canada wasn't independent simply because it remains a kingdom.
This is absurd. Canada + the UK have a long, rich history (including WWI + WW2). Newfoundland was given to them. Why spurn that now? The Queen is a nice, symbolic person. She doesn't do anything. I'd rather have the Queen be Head of State than Black Obama/Bush!! God Save The Queen :)
aw! fuck you with that black obama shit you just mad cause you a ice brit. at lease us americans don't have no one over us in another country. we can go and come to where ever the us rules or govern's you can't go to the uk unless on visa step brit lol
Yes, people travelling between foreign states require a visa. Aren't you a clever boy for figuring that out! Now, here's another concept for you to ponder: when your president is in another country, is he still "over" you or not?
your dreaming Canada is still the dominion of the Queen dominion means its a plantion and all of us over here are her subjects. Wake up slave and try to avoid participating in the second plank to the Communist manifesto a heavy and progressive income tax.
I, [name], do Solemnly swear (affirm) that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth the Second, Queen of Canada, Her Heirs and Successors according to law, forever. So help me God.
I don't get it. What are you talking about Napostriouf? Are you saying 300,000 quebec canadians have been deported to North Korea that nobody noticed? wtf?
Canada did NOT receive true independence in 1982. Canada in 2009 is still a Constitutional Monarchy. Technically, the Queen, not the people, appoints ALL persons to the posts of Government and Cabinet in Parliament, and the PM has to ASK the Gov. General (representative of the Queen) to dissolve, suspend, and open parliament. The Queen also retains veto (through the Gov. General) on ANY bill passed by the government, and has royal perogative to this day to pull a PM or Cabinet minister at any time.
Er, what part of constitutional monarchy doesn't equate with independence? Or, do you think that Norway, Spain, Sweden, Japan, Australia, the UK, Belgium, Denmark, Thailand, etc., etc. are not independent countries?
"100% free". You don't understand Canadian history, we were never UN-free. Canadians voluntarily chose Confederation in 1867 to preserve the different identities of the founding colonies, which were under threat of military annexation by the USA. Only the vast military power of the UK protected both English and French speaking Canadians from forced assimilation into the USA. The end of the USA civil war of 1861-64 resulted in 800,000 unemployed military men with guns south of our borders.
1 - It's not "re-" patriation, which implies we've done it before, it's "patriation". In 1982 we patriated (or tried to) NOT the Constitution, but simply an AMENDING formula for the Constitution of Canada. The power to amend had resided in the UK since the date of our TRUE "patriation," 1931, when the Statute of Westminster conferred full legal sovereignty on Canada. 1982 added nothing but amendment and a Charter.
2 - Part V of the Constitution Act, 1982, supposedly contains the Amending Formula (i.e., "formulae"). However, there are legal and technical problems with it that have been swept under the rug. Including the fact that while the "machinery" to amend was provided, someone forgot to confer the actual "power" to use it. Powere is "jurisdiction" and must conferred by express words, not implied. No express words confer "power" to use the amending formulae.
3 - Errors were made by Canada and the UK at the time of the "patriation" of 1982. Trudeau had no power to add the CHARTER which alters the powers of the federal Parliament and provincial legislatures. Section s.7(1) of the Statute of Westminster, 1931 prohibits such alteration: "7. (1) Nothing in this Act shall be deemed to apply to the repeal, amendment or alteration of the British North America Acts, 1867 to 1930, or any order, rule or regulation made thereunder."
5 - For the 1982 "patriation" to be legally challenged, a section 96 Court (Superior court of a province) must be seized of the subject matter, and render a judgment subject to appeal. Canada has a largely illegal Constitution, thanks to Trudeau; which has never been challenged in a real "Court" of law. However, there is still time.
Both. Canada and the Queen. And you have to understand the Queen has all thi power but we are independant 100% she isnt about to come here and say i want this this and this for the most part it is only tradition.
Ahhhhh but you're a Canadian citizen, therefore a subject of her Majesty and that be default means you have given allegience to her even though you never swore an actual oath.
@Aro2220 But any land you have purchased, you actually don't own in Canada. We Canadians are "freeholders" of land. It means we lease it...from guess who? The Crown.
Canada signed a lease with the Queen to uphold her policy sovereignly. You don't think the French sailed across 4000 miles of ocean do you ? Where - as stowaways?
Canada is not governed by itself, that date was the making of the constitutional monarchy, it was just a switch. All they did was give the queen rules she had to abide by.
The charter is a turdpile. - why? because of the notwithstanding clause, for one. It's a socialist's dream come true, a nightmare for people who want to keep everything they worked so hard for all their lives.
Freeing Canada from the British??? Canada is not sovereign when your head of state is the Queen of england?? If it is sovereign why are Agents of the Queen needed in almost every passing of a bill?
Check who has stock in the Bank of Canada in the actual Act it self...the QUEEN! Funny because I a Canadian can't have any!?!
Canada is not sovereign.
Definition - A sovereign is the supreme lawmaking authority...and she be the Queen...wake up!
1982 -- As Queen of Canada Her Majesty proclaims the Constitution Act 1982 on 17th April, which revised the Canadian Constitution, maintaining the monarchical nature of Canada and the Queen's authority as Sovereign. In March, as Queen of the United Kingdom , Her Majesty had given royal assent to the Canada Act which provided for the Constitution Act and transferred the residual powers of amending the Canadian Constitution held by the British Parliament to the authority of the Queen of Canada.
I was born in Canada, I live in Canada, and I'll probably die in Canada, but to be honest, I really don't have any real sense of national patriotism or reverance towards Canada, at least in the sense that "Canada" refers to a unique culture or set of traditions. Frankly, I'd be just as content with the stars and stripes rather than the maple leaf waving in the wind on local flagpoles.
LOL. you're ao predictable - you put a -1 on my comment. And i wouldn't be your friend, having my freedom sacrificed because of laziness is not a good idea.
Just listen to this idiot, a hockey series was an important event in Sovreignty and freedom. Are canadians that stupid, c'mon who owns the Bank of Canada ??? !WAKE UP! Get proerly educated or at the very least
You, sir, are the one who needs to wake up. Your definition of "informed" right now is that Canada has been "sold" to the U.S. I mean give me a break! There has been NO incidents of countries buying other countries...EVER! Another thing, when the hell is it mentioned in the video that the soviet/canada hockey series is part of our sovreignty and freedom, he clearly states parts of HISTORY. Maybe you should stop ripping on a young man's school work and be damn proud of the country you live in.
lol we became free AFTER the repatriation of the constitution? Because you know, there was no democratic tradition in Canada previous to that just typical liberal whitewashing BULLSHIT
By the way, in my Blog i do explaining it more deeply in English. Because, i think, that if we want one day things to stop, Canadians must know too, why we are acting like this, why we do as much polemic. I know my english isn't the best, at least, i do the effort to talk and explain in the language.
Excuse me if I don't understand exactly what you're trying to say, but, even if I completely comprehended how most of these comments fit the persona of Trudeau, I'd hardly be inclined to agree.
Just an aside: I noticed on your page that you were a Quebecois. A seperatist by chance?
I'm not separatist, i'm not against the independance of Quebec, however, that's not my main. My only fight is to make stop the oppression that we lived every day. I don't consider myself as Québécois, but has Kanadiens with K. As my ancestor was called too. In fact, most of people who's calling themself Québécois are in fact from Irish origin.
Friendly to us, and we are friendly to them too, however, that's an ethnical difference that is important because what we lived here are very hard and different between our ethnic. Do you know that over 300 000 Kanadiens was deported outside from Canada and never came back between 1970 and 1989? Do you know that my mother was without any other choix to flee Canada to go to North Korea as political refugee, the reason why that i'm born at Pyongyang instead my home?
Two things. One,Napostriouf, what are you talking about? Open your eyes, look, and listen, Quebec is getting what they want, accept it and move on. Second, Pierre Elliott Trudeau DOES NOT EQUAL Charles Montgomery Burns. You'd be crazy to think he does. SomeoneII, didn't like the movie at all.
And mostly what i'm talking about? You know, that is over 150 000 french people from Montreal and rural in Quebec currently living in North Korea as refugee? I'm born too to North Korea, my mother does fleeing that. My uncles and aunt doesn't got the same chance to flee. Some people, like my family does return after 1989, when things started to changed. You know, that theese thing, that the governement and Liberal party will never talk, because this is their crime.
Don't get me wrong, props for wearing your heart and country's flag on your sleeve, but I don't really want to see something about the soverignity of a nation that I just finished learning about IN social studies. Leave the schooling to the establishment.
What you learned about you're social studies, it's was it is accessible to you. When a governement is on conflict with a people they control almost everything in the nation. And mostly, everything about doctrine. Just understand, that when they denial, that mean for them that is not existing. About the same strategy that NAZI does to denied the existance of Jewish genocide.
And just for future reference, that was the worst flag waving in the wind I've ever seen. Lastly, one comment.... I never knew everyone in parliment clapped at the same time... Guess nobody wants to be different!
What are you talking about, which flag? Are you talking about the England flag with color changed and 4 lys flower added to make the current Quebec flag of soumission. We're not doing anything about our identity, that's a myth. That's a false debate; in fact thoose whoose debating about this are not us. You know that Gilles Duccepp is Irish origin? They've a different fight, cause they don't live the same thing that we live everyday here.

Maybe Justin Trudeau! Would be awesome to see him complete the Trudeau-Canadian Family Realm.

i mean...if i swear alligence to something or someone i'd tend to take that seriously.

no, i do not work for the government or military therefore i do not swear alleigence to the queen.

They have another culture and that's right. We doesn't matter about this, but just understand that this is not us.
