  • Who gets to measure whether it is offensive or abusive? And how far can this go? When Im gaming with someone why cant I say "F your mother!" I shouldnt be jailed for 18 months for that... The internet is like walking on the sidewalk, you can remove comments that you dont necessarily like in most open forums. When you let the govt police how to interact on the internet you have thrown out the baby with the bathwater.

  • Freedom of Speech is a privilege and people abuse this and abuse is not allowed.

  • @srppbhvgxtiv i went on the website and internet fucked your mum

  • I don't believe freedom of speech is a full right, it's more of a privilege. And if people are going to abuse that privilege by writing sick, hurtful comments, they should lose the right to any communication methods, from Facebook and Twitter to Landline phone and Royal Mail post. That way, nobody has to suffer the inconsiderate, misguided thoughts of cruel people.

  • Freedom of speech.. at least wat ik of it would not be used in proving this man innocent because he caused greiff to the parents disturbing the peace would go into place convicting him and in the end putting him behind bars. I agree with the procecuters

  • First off, Im glad that this asshole got arrested, it proves that the you arent safe behind a computer screen. Second,Freedom of speech should have a limit. Im not extacly sure where the line should be drawn, but the sad thing is that this is even an issue. Freedoms are taken for granted and abused far too often. My guideline is as follows: if what you cant say what your gonna say to the involved people's face then dont say it.

  • He should be jailed. If he said things that aren't true it's libel. That is a crime, saying someone did something when they hadn't. Also, causing someone so much emotional stress to a point where they kill someone is manslaughter.

  • he was just being a dick

  • I wish i had views like this guy. but i do montages :(

  • Dude deserves it.

  • Hey my YouTube fucked up and ramdom YouTube commentators on my sub list (on iPod) your one of them. I watched this vid yeah I liked it. Yeah I'm going to sub :)

  • @3000fireguy No that's not what i'm saying at all. Banning someone does not prevent them from doing it again. They could easily make another account or hassle another page/site. I'm suggesting another method of punishment that does not involve the person going to prison, but banning would only solve half the problem as they could do the exact same thing somewhere else.

  • we've been friends on youtube for ages, and i always see ur vids on my youtube homepage, this is the first vid i clicked on and i rlei like your stuff and have subbed :)

  • Joe he got jailed for 18 weeks not 18 months :D

  • @3000fireguy They could have done, but that would take away his right to freedom of speech. It's one complicated cycle that can never be fixed as the system cannot please everyone.

  • In America freedom of speech is freedom of speech, anybody can hate it or not doesn't matter (it is a law however that you can't threaten the US president).

In UK things are a bit different, so that issue is with the laws and constitution in UK

  • I agree with u

  • Here in 'Murrica, I can keyboard warrior.

  • wow this is deep stuff for a youtube vid. good work joe :)

  • well idc 2 be honest. now a days there is always someone waiting ready to report you, tats y i learned not to care and just live how i want my life and ignore ppl

  • Did you like hack my sub box

  • i agree with you joe

  • i agree with you. your freedom of speech, of movment stops when what you are doing is going to harm someone in anyway

  • You have your freedom as long as it doesn't interfere with other people's freedom.

  • I am a big believer in freedom of speech. If I controlled the site, I would ban all of his accounts. I don't think the government should get involved. Let the people who run the site take care of him.

  • @3000fireguy I understand he was expressing himself and his views, and I dont understand the rest of your comment (its gramerically incorrect and I'm having trouble reading it, ironically coming from someone who skips school 24/7)

  • I'm not sure exactly how it should be handled but I know imprisonment is often not the answer. It is very true that this guys state of mind must not have been, well, tip top to say the least. I think that we all have to take responsibility for our actions. I just wish that we would take a step out side of the orthodox view point of this and realize it is a direct reflection of what society is putting out now days. we have to be the change we want to see! and not just look for who to blame!

  • i do think there is afine line between bulleing and freedom of speach

but i also think you need to listen to everyones opinion even if you dont agree

  • Freedom of speech has a limit, as long as it doesn't cross into another persons views or their speech, or if it offends people.

  • I think you should be able to say whatever you want. But you shouldn't say shit like this guy did

  • it was 18 weeks Joe... no where near long enough!

  • totally agree!!!... i think the law actually says that you can say whatever u want unless you r threatening someone... or endangering someone.

  • Seriously, ur like/dislike ratio is awesome, so r you <3

  • It sounds like a simple case of harrassment. It's illegal and he should go to jail for the extent that he carried out the harrassment.

  • I think people are fretting over it because it could be considered a invasion of privacy, just like listening in on phone calls (which is done these days by the police in case of terrorist-activities). I think getting 18 months in prison is a bit much for what that guy did, he should of recieved a punishment, but that was a bit high.

  • wow je plz reply but can u check out aameplay i have in my file share its a 45 second dogs on domination nuketown fal dual mag

  • @3000fireguy but being a bully sometimes is not what an asshole is.An asshole is a bully all the time and is the guy who bullies you on a day to day basis. What you say is true, but being mean to someone is something everyone does eventually.what the guy did was terrible, being mean to someone once is unkind,Being an asshole to someone is different ,and there is a line to be drawn. What that guy was doing was being an asshole.

  • People should get to say what they want up to the point, I mean if it starts to be discrimination against race, gender, ethnicity, place of origin, or religous views then it should stop being used PUBLICLY! If some racist (a$sh0l3) is being his/her rascist self in their own car then it should be fine but only in private if its still not offending anyone

  • @3000fireguy guess so don't you just love it

  • I don't think this person should have gone to jail, I think he should say sorry to every single person he hurt, and at least 500 hours of community service. This is just horrible, calling people hurtful things after their death on a memorial page for them. I also know of one other story going on ask we speak, or should I say type. Someone is making very hurtful and DEFINATELY not acceptable accounts making fun of Woodysgamertag's son because he has special needs. This is just not right! >:(

  • freedom of speech just allows you to expres your uppinion.

and yes the wil be people offended by it. but what this guy is doeing is countiuslie make peoplo's live a hell an therfore isnt freedom of speech it is an act of crueltie.

    sorry fore the typo's

  • what we need is limited/controlled freedom of speech... here in the usa this "i have the right to say this, its my freedom of speech" gets way out of hand. back in highschool i had a friend who was gay, and every single day he would get picked on. when we talked i urged him to talk to the principal about it he said he had and nothing ever got solved because it was the other kids "freedom of speech"...wtf kind of system is that?

  • wheres ur raps on black ops! part 3

  • God bless the person who got bullied, she should have lived a good life but it's ended from somebody who had nothing nice to say.

  • Good day everyone

  • Everyone should have the right to freedom of speech but when it goes as far as to intentionally hurt other people then the person responsible should lose that right.

  • joe, at school we can only get 1 piece of meat :( so someone in our school made a facebook page asking 4 more meat (it has 400 folowers in 1 day) so i went to the head of the school and told her right iin her face that she need's to give us more meat, cuz if she doesn't do it more and more people will start to go eat home or something alike so you will make less money, her reply: ow you little twat shut the fuck up you dont know what you are talking about so keep out of this

  • @GYLYH i find that hard to believe... but i wasn't there so i guess i have to believe you..

  • @GYLYH your head of school said that? WTF? Report that bitch.

  • i was like o_O are you alowed to talk to a student in that way? so i told her to shut the fuck up and give us meat, she: deal with it, if you have still have hunger after you've been to the canteen, go eat at home i was like: ok i'll eat at home :( day after everybode who wanted more meat went home (only 45 people at the canteen) she went to me and said: FINE u can get as many pieces of meat you want me: :D PS: she was yelling at me in the middle of the playground ,might have exaggurated a bit

  • Everyones point is different though isn't it, some people are easily offended, others are think skinned and don't give a shit, freedom of speech will always be a difficult topic.

  • Although this GUY did say horrible things and deserves his punishment. The biggest thing in the world today is the Media/News induced "NORM" there's like a nationwide stigma on how we as person should look, talk,be like. Amongst my homosexual friends I can freely say Faggot or Queer but saying them out and about I'm a bad person. It's just a word!!!

  • freedom of speach "is just that, the freedom to speak" you also as a human have the right to be offended. Freedom of speach only stands until 1 outside party (not the speaker) becomes offended. At that point you have lost that freedom.

  • Yout can only go so far with freedom of speach... I think that you should be able to tell other people what you think, but with all the crap that the guy you were talking about, i think that it is going to far. I mean I believe that I can tell people that they did a sucky gameplay, but when you talking about serious matter like this, then you should keep your comments to yourself. Im not going to the family of the people who died in 9/11 and say that their son was a retard, that's just not right

  • you're free to say whatever you want, but that doesn't mean you SHOULD say it, and there is a line between what you are allowed to say, and there's a line were you just don't say or joke about something. It's should be pretty obvious for a human being where that line goes, cause we're all human beings(except Joe he's a beast!) and we should know when to not joke about stuff like suicide and other things.

sorry for my very poor english, i'm not from any english speaking country ;p

  • Good topic though, Joe. I like these kinds of things to talk about.

  • One of the problems with being punished for offending someone is that you have to decide when to draw that line, and with a broad law it can't be a case-by-case basis; it has to be more definable.

Ever seen a movie or TV show where a character yells at another character that they're being worthless and pathetic or whatever to try and inspire them to change? Well that could get someone jailed under this law. You can offend people without intending to, and you can't know someone's intent.

  • i really think that freedom of speech should be however you like at home but not outside

  • I think that putting a man IN JAIL for offending someone is too far. It's not like he physically harmed any of them, he was just mean. I would love to put people like the Westboro Baptist Church in jail, but you can't do that just for speech, no matter how hateful.

A hefty fine would have been an appropriate punishment, but going to jail for a year and a half is just way too much.

  • fuck free speech haters and fuck pc

  • freedom of speech motherf---er B-D

  • Comment removed

  • Cont. Just by saying that you can't have freedom of speech takes away their right to do so. If they still do then they will get a criminal record which can prevent a person from getting certain jobs, which in turn takes away their right to work. So this system that says what we can say and what we can't say is wrong. But there will never be a definitive right and wrong as there will always be exception depending on how bad the offence is.

  • "How far should freedom of speech go?"

As soon as you put limitations on it, it is not free speech. When you give the government the authority to dictate who can say what, then you have given them the ultimate power in my opinion. One of our only weapons against government is our freedom of speech. Now, I am no way agreeing with what this guy did, but I cannot hold him criminally liable for it. "I disagree with what you say, but I'll defend to the death your right to say it."

  • when you search FaceBook that comes up

  • I believe that freedom of speech should only be allowed as long as the person does not seriously offend another person. It is wrong to write on these memorial pages/sites saying hurtful things, but i do not think a person should be jailed for doing so. In my opinion being jailed for just offending someone or a family is a bit drastic. I'm sure there are more suitable punishments that won't get them a criminal record as it is not illegal to speak your mind. Why prevent someone from getting a job?

  • i agree that you can speak your mind but when you start bullying or quite badly offending others with what you say it should be stopped

  • Whatever you say it will offend someone. But that guy is not nice

  • MW2Joe is there any special requirements for the gameplay and how do we sent it to you?

  • im the 117 viewer ohyeah

  • Freedom of speech would work if there weren't assholes, but as the law stands it is not going to work.Bullies use it as an excuse, and authorities can't complain because it is written in the law.Americans have bigger fish to fry that wether people should be allowed to post COD videos on the internet.

  • Where do you draw the line at "offending" or "upsetting" others? Cursing could "upset" someone. And the views of some do not reflect the whole, but if we do not allow them to express their views, then aren't we saying there's a right and a wrong way to act? And if we do, who is setting the standard? The Church? What about those who aren't religious? Doing what that guy did was despicable, but let's not give up some of our rights because a few bad apples ruin the pie.

  • The issue isn't really freedom of speech, it's how you police it and who enforces it that's the problem. Also, it's obvious that the guy didn't use common sense, or just said what he wanted to hurt someone else.

It's not a good thing if the government has the authority to put you in jail for the things you say. I fear living in that world. Would people stand up to tyrants, or fear them? If the government enforces limitations on free speech, then it has the chance to get out of control.

  • @Majikman007j Excellently put. This is a great discussion

  • @Majikman007j You are fearing governments putting people into jail for speaking against the government. This isn't the case here. Here is a man who was intentionally looking to hurt and abuse people behind a keyboard. Can we differentiate between mental abuse and physical abuse, is one worse than the other? Is mental abuse allowed? This isn't a government prosecuting someone for speaking out against them, it's the police protecting people arguably. Thanks for your answer :)

  • @MW2Joe freedom of speech should go as far as to be able to speak your mind freely amongst a crowd that agrees not a place of conflinct in which what is right and wrong and what you say should create a major spark of self destruction if you do start this then you should get jailed and his freedom of speech has been abused and he should not have the right also Y U NO LET PLAY WIT CHU!

  • @MW2Joe Yeah, but where does free speech stop and common sense begin. Once the government (of any country) starts trying to control something, then who limits the government.

I don't disagree. This guy's just a horrible person. Scum of the Earth, and deserved punishment. But by the government/police? I just think there should be a better way to police it.

  • its just words people should just look past it he should be able to say what ever he wants no one should be able to tell someone what they can say

  • 18 weeks*

  • instead of being jailed he should have internet access taken away for the rest of his life

  • It's a complicated issue, people shouldn't be able to do things like that, but there is a fine line between exercising your freedom of speech and being a complete ass.

  • I think the furthest that freedom of speech has gone is that this guy in texas stood outside of a ruplican building and starting to burn the american flag and wave it around, he didnt go to jail due to his freedom of expression. In my opinion that guy from the article deserves it, thats just a horrible thing to do :( but life is full of mistories and disappointment, but also full of happiness and love, kindness and hate, cheaters and liars, honest hearts and generous people :] I agree with you

  • Who gives a shit, peopke nowadays are way too fucking soft.

  • @qwertymanor That is very true, But what he Did is over the damn line man Their Daughter/ Son had died you woudnt have Liked that? But yeah People are Soft as hell Today

  • not first

  • let them say what ever they want but just don't give them any attention! thats what they wanted in the first place!

  • i agree with joe it has a limit its ok to have an opinion but he took it to far.

  • interesting topic to talk about very thought provoking.

  • interesting topic to talk about very thought provoking.

  • in holland it is it freedom of speech but you can't say like bad things to people

  • boost server?

  • wow that person is an ass hoal thats bullshit you cant go around saying that now for the freedom of speech its freedom of speech its its i dont know what to say honestly if the guys said that i think the familys should get involved and not the police because freedom of speech is freedom and you should be able to say what you want even if its complete bull like that to be honest
