This is going to court.. Just read it on local news. Many people say its in violation of their 4th amendment. And the police need a warrant to search the vehicle. Even a retired police officer of SDPD says the cop had no reason to break this guys window.. We'll see how this turns out in court. Hopefully these guys win their case.

The violation is being stupid in a no stupid zone.

They were clearly obstructing a lawful operation by not cooperating. As soon as the driver refused to cooperate, chatting should have been over right there.

They must have a reasonable suspicion that a crime has taken, or is about to take place. They did not. They violated these guys 4th amendment rights.

I want the police to have a reasonable suspicion that a crime has taken place, or will take place before they can detain and ID me. The next step will be going door to door and asking for ID.

Anyone who doesn't think our public servants, the police, have the right and authority to be checked for sobriety is unfamiliar with the number of deaths that take place at the the hands of intoxicated drivers.

These jerks should have cooperated and they could have been on their way in 10 minutes. I have been stopped by sobriety checkpoints and had no problem whatsoever. The police were overly patient. Stupid, wise punks.
