Libertarianism requires responsibility; tort litigation can only go so far. In the mean time, regulation is a balancing mechanism.

My brother made that same claim about private property and tort law, but it's problematic in areas not conducive to human habitation, such as mountains, rivers, oceans, etc., where no one individual is the plaintiff in such an action. An oil spill in the ocean, for instance, could not be litigated this way. remember, the Exxon Valdez spill was never cleaned up completely.

Part of 'being able to make their own decisions' includes the concept of property rights. When we strictly enforce private property rights, environmental damages are ALWAYS civil damages and subject to tort law.

My brother made that same claim about private property and tort law, but it's problematic in areas not conducive to human habitation, such as mountains, rivers, oceans, etc., where no one individual is the plaintiff in such an action. An oil spill in the ocean, for instance, could not be litigated this way. remember, the Exxon Valdez spill was never cleaned up completely.

Homesteading theory would have put the ownership of the area, including the ocean itself, in private hands. Imagine the risk oil tankers would face if the fisheries owned the oceans? Oil would cost what it should (more) and there would be fewer spills.
As a 'conglomerate' special interest, the government 'picks its battles', usually in the interest of self-preservation (maximize revenue, ensure re-election).

There is by no means a scientific consensus. Conversely, one hears much of the vehement minority of radicals, who wish to impose their dogma on the rest of us.
The data that support the notion of Global Warming are far from conclusive. They are, as Klaus and as many scientists indicate, theoretical.
And even if there were a majority of scientists who supported such a theory, would that make it real? Remember when the scientific community advocated smoking?

Regarding smoking, the scientific community did not advocate smoking; it was a few who were paid by cigarette companies and their PR firms to provide endorsements. According to wikipedia in 1964, the US surgeon general, backed by 7000 scientific articles, advised on the link with smoking and cancer. England reached similar conclusions earlier, in the 50s, but in Germany, those links were discovered back in the 20s.

It's the product of lazy thinking--everything one disagrees with becomes the enemy. Environmentalism seeks to demonstrate cause-effect relationships between industrial output and environmental degradation, and the costs associated with it, and to promote sustainable ways of living. It's also done primarily thru private organizations.

Regulations are put into place as a response to pollution and other ecological degradation that is ultimately harmful to all of us, sometimes quite directly. Corporate Industrialization has had the opportunity to clean it's mess up for a century and a half, and its unwillingness to do so has spawned the environmental movement in response. Freedom is proportionate to responsibility.
