As much as I liked Frank (and as right as he was when it came to Sosa...) he had to go.

Sure he could have taken his 10 mil and let Frank go... but this guy already had tried to kill you once. What's to stop him from trying again?

And the money Tony would be making as the kingpin of Miami and with Sosa (remember, Tony was all about expansion while Frank kept it low-key) would make 10 mil look like bus fare.

Tony is also redeemed at the end of the scene because he gives Erni a job. So he is absolved of all his sins and we continue liking him because he is such a nice guy.

@syko567890 Think it's more that he has a personal code that can think on levels, so he rightly realizes not only can Ernie become an employee, but that doing so absolves him from having to kill Ernie. Which was a secondary consideration; for example, the guy who put the scars on Capone's face(the original 'Scarface') was ultimately hired by Capone for his skills as a knife-wielding bodyguard, and not revenged.

i always liked this scene, Mel went out hard as opposed to the "Boss" Frank and I like how the music just stops when Tony say "You wanna job Ernie".

That line was always so badass and funny at the same time. But i always thought the producers were overconfident on that line. Tony didnt have that kind of vile and smart sense of humor at the same time. He had balls but he wasn't that intellegent as a character. And what are the chances he would even know what resurrection means? A recent Immigrant from Cuba speaking broken english couldnt use that word. :D
