The basic logic on this is simple. We do not get to define what torture is, those things are defined by international treaties WE were instrumental in putting through. We are signatories to these treaties and therefore these definitions are our definitions. This is because, according to our own constitution, our commitments to international agreements supercede our constitution when in conflict. Therefore, Bush/Cheney et al are all war criminals whom Obama just said he is unlikely to prosecute.
