nclb is a crock of shit and will always be as long as the emphasis is on standardized testing and black and white data on paper. But the larger problem is that nclb is unrealistic, inadequately funded, and emphasizes all but the MOST important factor that influences children's acheivment: the parent(s)/guardian(s).
Confidence intervals are mathematically sound. You can't argue with them. However, adding 3 points makes no more sense than subtracting 3 points, when the 95% (or whatever) confidence interval is plus or minus 3. The scores ought to be reported as-is.
