As an electrical engineer I can tell you the age of encryption is gonna be over for the pigs. New apps will track their squad cars based off their GPS locaters and all of the electronics they are using. When this happens we will all be able to avoid those pesky pork choppers and their FAGGET AGENDAS. Aside from that fact, encrypted or not, soon enough there will be independent funded satellites that track police based off all the bullshit electronic signals their squad cars emit into the air. No it's not illegal.. Freedom of information act and all that. Scanners are easily purchased from electronics stores to listen to them and the channels your departments operate on are listed. The police for tactical operations have encrypted channels that you can't hear.

It's only illegal if you talk on or disrupt the communications of their radios.

Some states do make it illegal to be in possession of a police radio, or scanner while in a vehicle. This would make it illegal to have your iphone, or ipod touch with this application running, in your vehicle.
