The officer probably told the nut to get off the street. The nut refused, the officer was forced to take action. There's a certain type of idiot that blows up everytime a tape without audio shows up of a cop scuffling with someone who is arresting arrest... I'm not one of those. If the man was retarded, this is an unfortunate mistake. I would get angry if someone does what the cop says, and the cop beats him anyway, or is seen beating someone totally innocent.

view it again, this is obviously at doublespeed, so some things go by fast but it appears at 0:17 the cop is trying to get him to put his hands behind his back, and he turns around and faces him instead, it looks like the cop tries to turn him over to handcuff him several times on the ground, but the guy keeps rolling back over and facing the cop, this is especially clear at 0:25 . Other times the cop is trying to turn him around to cuff him are 0:38 and 0:55 . Must have been the tard-i-ness.

You take your victims as you find them. It just so happens this guy outclassed the cop, but only after he was bounced off the car and to the ground did he "resist" at which point he was acting in self defense. The fact remains it was the police who initiated the altercation.

We can only guess he might have mouthed off to the cops, but physical violence in response to verbal abuse is unlawful, even for police.

It has been suggested above, the cops may have observed an offense prior to the start of this vid, but you can see by their nonchalant approach initially they were not overly concerned prior to the exchange of words.

Both officers have been suspended without pay, one of them for falsifying a report pertaining to this incident.

Looking again, the lamp post is partially obstructing the view of action at a critical moment, and since the police report is known to be fraudulent, its difficult to determine the exact circumstances. The charges resisting arrest, disorderly conduct and wandering for the purpose of obtaining controlled dangerous substances are weak.
