i mean it might be a win but it isn't a win in itself. if you make it to appeals court, they can either overturn the conviction, throw the case out, hear the appeal, or uphold the conviction.

If they hear the appeal you have to go to court again and make your arguments on why you think the original court messed up in such a way as it could have messed up a fair and impartial trial. If you fail, the conviction is upheld. If not, maybe they will just schedule a retrial.

is it possible to defend on a ticket that involves an accident? basically I was in one that involved paint damage and nothing else, but it was my fault. Is there a way out of that?

What I got ticketed for was failure to maintain control, but I feel the person in front of me slammed on their brakes too hard (in bumper to bumper traffic/traffic jam) and caused the accident.

Recuse your judge based upon illegal payments from L.A. county to the judge, CCP170.1 & CCP170.3 as per the california constitution judges are employees of the state. article Vl section 19 andcanon 4D(1) (sturgeon vs Los Angeles County) and senate bill SBX211. SBX211 granted them retro active imunity from taking bribes from the County. but it did not grant them imunity from precideing on a case that they would be biased based upon the illegal payments. Judges are employees of the state not the county and the county has been bribing them at the tune of $57,688.00 per judge per year. the judge is biased based upon the payments from the county.

The only time i got a ticket was in Long Beach and I fought it. I got the fight your ticket book even know I am an attorney to help me see what the traffic court does. The fight your ticket book has pleading to help you too. I filed a motion that my rights to a speedy trial was violated and won. LOL it cost me 104.00 dollars to fight it and the fine was 105.00. Good luck and get the book it will help if you want to fight it.

In a ticket case it is legal for the county to hear, fine or let go any violation. On a case i worked on civil I filed a motion to dismiss because Plaintiff failed to Proof the actions in his case of action.

The motion to dismiss would not work in this case because it is the right county but wrong COUNTY courthouse. Try a motion for venue and move it to the right County courthouse. This makes it harder on the officer to TESTIFY. I can see that in your other video's you lost but that is cool. Buy a how to fight a traffic ticket court book to help you.

If you sign the ticket under stress and duress, then it can not be used in court, wheres the case? If you go the court two days after you receive the ticket (it says on or before that date) with two witnesses and ask to see the judge about it (the clerk says your not in the system yet) you have your witnesses write an affidavits attesting you showed up on that day and time and they would not see you, make copies of all and hand to the clerk and leave, no case, you performed they didn't.

If it were me and I could not cross examine the witness and its only the cop that shows up, I would file a motion to dismiss for violation of due process and hearsay. Whatever the cop says is hearsay since he did not witness whatever happened. Also, I would file a counterclaim against the judge for moving foward with the case while violating my right to face my accuser so that I may cross examine him.

It might help you to consider that police are poorly educated in the law, but since they have been 'trained' as officers they THINK they know the law. When someone knowledgeable like you questions them, it is seen internally as an attack on their authority.

They are humans after all, misguided as they may be.
