No where in US law does it specify anywhere that in order to be a natural born citizen, that you need two citizen parents AND be born on US soil. There are those that believe that is true and there are those, like myself, that believe a natural born citizen is simply someone that is born a citizen (a citizen at birth).
Title 8 of the US Code outlines 8 categories of how a person acquires citizen at birth status. People that fall into any of those 8 categories are considered NBC's.
There are no adoption records that prove Obama was adopted by Lolo Soetoro. Even if he was adopted, he would not have lost his US citizenship. In order to become an Indonesian citizen, he would've first had to have renounced US citizenship, which he could not do as a child, neither could his parents do for him.

The Certification of Live Birth does certify he's a natural born citizen. First off, it's a CERTIFICATE of BIRTH. It is also accepted by the State Department when issuing a passport. And while someone born in a foreign country CAN receive a Certification of Live Birth it will also list their birth location on the document. On Obama's COLB it lists his birth location as Oahu, Hawaii. If he was foreign born the document would list it.

Barack Obama had DUEL citizenship when he was born because his Father was a Kenyan and Kenya was a colony of the UK. Obama lost his Kenyen citizenship in 1963 when Kenya gained independance from The UK but was still considered a citizen of the US because he was BORN here. There is no definition for Natural Born Citizen anywhere in US law. That is why the 14th Amendment applies because it gives us the closest thing to a definition. And it is all based on the principle of jus soli. In fact the 14th Amendment goes so far as to strike down the right of jus sanguis, right of blood, as requirement for those born on US soil. So it does not matter who your parents are if you are born on US soil.
Not all US citizens are eligible to be President, simply because they were born in the US. Natural born citizens, are those born in the country, of parents who are citizens. Being the child of citizens, and being born in our nation, would mean that they were born having no allegiance to or fall under the jurisdiction of any foreign power. Obama is NOT a natural born citizen, and he has never provided proof that he is a US citizen.
While the term "natural born citizen" was not defined in the Constitution, many other legal terms used in it were not either. However, the Constitution did grant Congress the right to pass immigration laws. The very first Naturalization Law of March 26, 1790 states "the children of citizens (plural-meaning both parents) of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens".
That law was followed by the Naturalization Law of 1795, which very clearly states the the children born to foreign fathers, who themselves had shown no intention of becoming a US citizen themselves (like Obama's father, who was only here on a student visa), would not be considered US citizens. The immigration laws are now less strict, however, the legal definition of "natural born citizen" has remained the same. Obama is NOT a natural born citizen of the United States.

Yes, under US law, a child born with dual citizenship is still a natural born citizen as long as he was born on US soil. Your definition of Natural Born Citizen exists nowhere in the US legal canon. It is meaningless in this argument. Obama's British (Kenyan) citizenship existed until he turned 21 under US law (these days it lasts until the age of 23). At which point, for him to have continued to hold British citizenship, he would have had to denounce his US citizenship. He did not.

Bigone, you are wrong on so many things that we have to take these one at a time. The 14th Amendment grants citizenship by jus soli, the right of birthplace. By being born in Hawaii, Obama is a natural born citizen as far as US law requires. His parents do not have to be citizens for him to be one. As far as the British Nationality Act goes, that is a British law, not a US law. If he was running for Prime Minister, it might have merit. But he was elected President, so it means nothing.

Obama's COLB proves that he was born in Hawaii. You are wrong about the 14th Amendment. The only part of it that requires parents to be citizens is the one dealing with children born outside the US. The 14th Amend. allows an out for people under sovereignty of another nation which covers children born to diplomats and foreign soldiers serving in the US. There is nothing in the Constitution or otherwise that says that your parents have to be citizens for you to be an NBC.Obama is, Jindal is also.

I have read the 14th Amendment and the opinions written about it. I had my sister, a lawyer, research several pieces about it. It sets precedent for everything that I stated in my previous post. There is nothing in it stating that your parents have to be citizens for you to be a natural born citizen. Obama is one, Jindal is one. You need to do more research or at least stop trying to twist things to suit your mistaken argument.
While it is true that the term "Natural Born Citizen" is not defined within the Constitution, there was clearly a distinction made between a citizen and a natural born citizen. If there is no difference, why did they use the term? Many other terms are not defined either. The Constitution is not a legal dictionary. Should we discard all the words and phrases that were not defined?
Perhaps you and your sister can now explain to all of us how citizenship was determined before the 14th Amendment was ratified? Or did everyone run around saying that the term wasn't defined in the Constitution, so we don't know what it means to be a citizen yet?

The 14th Amendment was put into effect to make all Americans citizens of the Nation, as opposed to citizens of the individual states, in order to make it harder for states to secede from the Union. They wrote down what made a citizen at birth (jus soli) and it takes precedent over anything that came before.

Before the 14th Amend., the States were basically small countries united under a federal gov't. Just traveling from one state to another could be troublesome and costly. Most people considered themselves Virginians or Kansans or whatever instead of US citizens. After the Civil War, the impetus of the 14th Amend. was to 1) incorporate the freed slaves into the US population and 2) make us all US citizens first and foremost, so that another Civil War would be harder to start. Simple US history.

Yes his father was born in Ireland, but he became a US citizen after Arthur was born. It was suspected at the time he was running for vice President, that he was born in Canada, but it was proved that he was born in Vermont. A President must be a natural born citizen, but their parents can be naturalized US citizens. Back then a naturalized citizen was required to renounce all former foreign allegiances and titles. See the Naturalization Act of 1795.
Like I said a few days ago, his natural birth status was questioned by many before the election. It was believed he was born in Canada, but it was proven he was born in Vermont. I would assume he proved that with a birth certificate. You must remember, that there were no computers, phones, fax machines,etc back then. It is the job of the State Electors, Congress and the media to check a man's eligibility. This was always done, until last year.
It did not hurt the the nation, because his father became a US citizen. There are no adoption records that prove he was adopted. It wouldn't matter if he was....

No where in US law does it specify anywhere that in order to be a natural born citizen, that you need two citizen parents AND be born on US soil. There are those that believe that is true and there are those, like myself, that believe a natural born citizen is simply someone that is born a citizen (a citizen at birth).
Title 8 of the US Code outlines 8 categories of how a person acquires citizen at birth status. People that fall into any of those 8 categories are considered NBC's.

There are no adoption records that prove Obama was adopted by Lolo Soetoro. Even if he was adopted, he would not have lost his US citizenship. In order to become an Indonesian citizen, he would've first had to have renounced US citizenship, which he could not do as a child, neither could his parents do for him.
Section 349(a)(5) of the INA explains this quite clearly.

Obama was born in Hawaii, his mother, age 18, was a US natural born citizen, his father was citizen of the British Kenya Protectorate. To be natural born citizen you just need to be born in US, and both parents must be US citizens. His father citizenship is relevant. Obama is a dual citizen, not a US natural born citizen, and he is not constitutionally eligible to be a US president. It's possible he was born in Kenya, and under 8USC1401(g) Obama is a British citizen.

The Certification of Live Birth does certify he's a natural born citizen. First off, it's a CERTIFICATE of BIRTH. It is also accepted by the State Department when issuing a passport. And while someone born in a foreign country CAN receive a Certification of Live Birth it will also list their birth location on the document. On Obama's COLB it lists his birth location as Oahu, Hawaii. If he was foreign born the document would list it.

The Newspapers did not record where Obama was born. When his birth was registered, a Certification of Live Birth was issued, and the Newspaper printed an anouncement. BTY, a private investigator has spoken to the people that still live right next door to the address in the anouncement, and they have no memory of any white woman with a black chold ever living there. No hospital in Hawaii has any record of the birth or of Barack or his mother ever being a patient.

Barack Obama had DUEL citizenship when he was born because his Father was a Kenyan and Kenya was a colony of the UK. Obama lost his Kenyen citizenship in 1963 when Kenya gained independance from The UK but was still considered a citizen of the US because he was BORN here. If he had dual citizenship, then he is NOT a natural born citizen. It does not matter that he lost his dual status in 1963-the point is he was not born that way. A natural born citizen, cannot be a dual citizen. "Natural Born Citizen" is a legal term, meaning one born having allegiance to, and being under the jurisdiction of only one country. There is no definition for Natural Born Citizen anywhere in US law. That is why the 14th Amendment applies because it gives us the closest thing to a definition. And it is all based on the principle of jus soli. In fact the 14th Amendment goes so far as to strike down the right of jus sanguis, right of blood, as requirement for those born on US soil. So it does not matter who your parents are if you are born on US soil.

Not all US citizens are eligible to be President, simply because they were born in the US. Natural born citizens, are those born in the country, of parents who are citizens. Being the child of citizens, and being born in our nation, would mean that they were born having no allegiance to or fall under the jurisdiction of any foreign power. Obama is NOT a natural born citizen, and he has never provided proof that he is a US citizen.

However, the Constitution did grant Congress the right to pass immigration laws. The very first Naturalization Law of March 26, 1790 states "the children of citizens (plural-meaning both parents) of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens".

That law was followed by the Naturalization Law of 1795, which very clearly states the the children born to foreign fathers, who themselves had shown no intention of becoming a US citizen themselves (like Obama's father, who was only here on a student visa), would not be considered US citizens. The immigration laws are now less strict, however, the legal definition of "natural born citizen" has remained the same. Obama is NOT a natural born citizen of the United States.

Nice try! It expired on August 4, 1982-his 21st birthday. Hawaii law requires them to create a Birth Certificate when a foreign birth is registered. This is what they are calling his "original". You too have a long form Birth Certificate, that is held by the State in which you were born. Obama is the only President, whose status was questioned, and he refused to comply. Yes, under US law, a child born with dual citizenship is still a natural born citizen as long as he was born on US soil. Your definition of Natural Born Citizen exists nowhere in the US legal canon. It is meaningless in this argument. Obama's British (Kenyan) citizenship existed until he turned 21 under US law (these days it lasts until the age of 23). At which point, for him to have continued to hold British citizenship, he would have had to denounce his US citizenship. He did not.

You do not even know what S Res 511 is, do you? It was a resolution (not a bill) passed by the Senate. It has no force of law. It is basically just the Senate saying "Here is our opinion...". All it did was offer the Senate's opinion that there was no doubt that John McCain was eligible to run for President even though he had been born in Panama.

Bigone, you are wrong on so many things that we have to take these one at a time. The 14th Amendment grants citizenship by jus soli, the right of birthplace. By being born in Hawaii, Obama is a natural born citizen as far as US law requires. His parents do not have to be citizens for him to be one. As far as the British Nationality Act goes, that is a British law, not a US law. If he was running for Prime Minister, it might have merit. But he was elected President, so it means nothing.

I have read the 14th Amendment and the opinions written about it. I had my sister, a lawyer, research several pieces about it. It sets precedent for everything that I stated in my previous post. There is nothing in it stating that your parents have to be citizens for you to be a natural born citizen. Obama is one, Jindal is one. You need to do more research or at least stop trying to twist things to suit your mistaken argument.

The 14th Amendment was put into effect to make all Americans citizens of the Nation, as opposed to citizens of the individual states, in order to make it harder for states to secede from the Union. They wrote down what made a citizen at birth (jus soli) and it takes precedent over anything that came before.

Before the 14th Amend., the States were basically small countries united under a federal gov't. Just traveling from one state to another could be troublesome and costly. Most people considered themselves Virginians or Kansans or whatever instead of US citizens. After the Civil War, the impetus of the 14th Amend. was to 1) incorporate the freed slaves into the US population and 2) make us all US citizens first and foremost, so that another Civil War would be harder to start. Simple US history.

Yes his father was born in Ireland, but he became a US citizen after Arthur was born. It was suspected at the time he was running for vice President, that he was born in Canada, but it was proved that he was born in Vermont. A President must be a natural born citizen, but their parents can be naturalized US citizens. Back then a naturalized citizen was required to renounce all former foreign allegiances and titles. See the Naturalization Act of 1795.

Like I said a few days ago, his natural birth status was questioned by many before the election. It was believed he was born in Canada, but it was proven he was born in Vermont. I would assume he proved that with a birth certificate. You must remember, that there were no computers, phones, fax machines,etc back then. It is the job of the State Electors, Congress and the media to check a man's eligibility. This was always done, until last year.

It did not hurt the the nation, because his father became a US citizen. Obama's father was a communist, who abandoned his son, and returned to Kenya, only to have his ideas fail, be thrown out the government, and die a drunk. Obama now wants to put those same failed ideas practice in our nation. He already has caused a great deal of harm to our nation, that will last for generations, and you are too blind to see it, because all you care about is having a black face in office.

"Now you are contradicting yourself"? Yes that is the law. Are you now saying that it was known at the time that Authur's father was NOT a US citizen? It was only realized a few months ago that his father did not become a citizen until after Arthur was born. How is this a contradiction? Are you saying that once a law is broken by someone, that it is ok for everyone else to ignore the law?

The lawsuit is merely for proof of his eligibility. To this day, no acceptable proof has been produced. He won't be removed from office by lawsuit. He'll be removed by impeachment for fraud, end of story. Of course, if our country isn't in martial law by then, we'll be able to take our country back.

Right. It's controlled by the Democrats. But if the proof is brought forth into light, and America see's the proof that he's illegally in the seat of the President, then they would have no choice but to remove him, otherwise there'd be mass revolt throughout the US by angry citizens who see their government is no longer for them. Trust me. Once the proof is out in daylight, he'll have no choice but to resign or be impeached. Think about it, and maybe your mind will wrap itself around that.
