So I'm assuming Mr. Jones will counterclaim with a fair use claim. However, the defendant bears the burden of proving that his use was "fair" and not an infringement. DMCA actually reduced the reality of fair use rights.
Fair use does allow others to show their own work, which does NOT appropriate someone else's. There are limitations.

I've spoken with a few younger christians arouind my age on YT and most of them don't understand why what VFX did was wrong. They said that VFX was justified because it was his own videos and it was his copyright.
So I think it would be a good idea to prosecute him so at least other young people can learn how there's a difference between intuition and legal precedence.

I can think of one possible outcome:
VFX will be sued for a great amount of money, which will be used to donate to that one charity (I forgot which one).
Some atheist videos were campaigning for a charity drive, to make up for VFX's scam, which was the refusal to donate money, and instead keep the money for himself. This might hit two marks with one stone.
