I recently beat a DWI. I went through all these tests, and my lawyer told me that it's stupid to do them. If the officer is asking you to go through the tests then usually he's already decided to arrest you, and all you're doing is just providing the state with evidence. If there are no refusal warrants being signed I'll blow, otherwise I will not make the mistake of providing evidence against myself again.

as a DUI instructor I would not have arrested her based on what I can see here. However, the true test is the HGN test, added tot he vehicle in motion, and the interview prior to testing. So without seeing those things it is hard to a make a judgement, but I dont think she was impaired form this video.

this test is not that accurate - if you loose your balance doesnt necessarily mean your intoxicated

The only real test is simply the blow test or blood sample. If they should base if she is capable to drive or not by the test she had here, they simply should let her go. She passed the test.

FUckin cops, I didnt see her do anything wrong. THese field sobriety test are being challenged in courts now. THis woman was going to get arrested one way or the other. Im suprised he didnt tazer her, of course, for her own safety.....

I like cops but this guy is out of line, she pasted. So here's what you do, get a lawyer and take it to court. After you win and the charges are dropped you file counter suit to get your attorneys fees out of the cop. Then file a complaint with his IAD. After internal affairs gets though with him he will think twice be for he gets a power trip going again.

If she performed the way she did on the test and was still arrested, I don't know how you're supposed to do NOT to be arrested. Are you supposed to tell the officer the routine and then do it backwards?

REFUSE!! 5th amendment!! You can refuse ALL and EVERY form of Alcohol tests. in my state for doing so you loos your license for 6 months. thats better than the YEARS of crap you will get for a DUI. Refuse and you will be ok in the longer run.
