@OblivianArchAngel In a civil case, such as this, it's up to the Judge to decide who wins or not. It's based on percentage of fault, I would say 90% of fault was on the defendant, 10% of the plaintiff, and thus the Plaintiff wins the case. Also, just as a heads up, I think the defendant only has to pay back the, what was it, $400-$500-ish, and the company who sponsors the show pays the rest. Not sure how accurate that is, that's just what I heard in my law class a few years ago.

It's so stupid that I, a person who has never even glanced at a law book, knows it's stupid. lol. Another mistake is at the top of the ad it says 'What you see in the picture is what you will get'. If the seller wanted people to know it was the picture only and was a normal moral human being, to avoid any possible confusion they would say in large red letters on the front of the ad that it isn't the phone but a photo of it. Her immoral intentions are so clear.

I was watching a clip of 'The People's Court' in which a man was sueing another man who sold him an office cubicle because it didn't have many parts with it to put the cubicle together. On the eBay ad he put that he was selling an office cubicle with 'some' parts. The man who was selling the cubicle won because the judge ruled that he put 'some' in his ad and not 'all'. She said you should never 'assume'. However this eBay Scam case was won by the person who assumed

It is so obvious she intended people to buy it thinking it was a phone and then when they complain to point out that she said in the small print that it was just the photo she was sellling. Had she been genuine, she would have put all her effort into making sure such an obvious mistake wasn't going to occur. Why would someone spend so much money on a poorly printed picture? Or better yet, why would someone put up a poorly printed picture on eBay for so much?

Even though this episode of Judge Judy was taped five years ago, I was curious about what ended up happening with this vile Kelli Fillkins and did a little research. She was prosecuted in Michigan and lost her kids (thank God! for the kids that is.). She is no longer married and her husband admitted to being in on the scams and verbally abusing people who called their house to complain.
