  • I'll tell you where Thad Cochran stands. He made "PORKER OF THE MONTH," for April 2010. Don't expect much from this bum. If I have my way, he won't get enough votes to stay in office. I live in Mississippi.

    When he voted pro-rape, he WAS IN FACT, "De Facto" writing a law that meddled between companies and employees.

  • Furthermore, the Franken amendment does NOT dictate contract law. It only stipulates that companies with clauses like this will not receive government contracts. They can still have whatever they want in their contracts, but the government won't hire them. That's reasonable. It also makes Thad Cochran's argument dead in the water.

  • Aren't ye making a big deal about nothing? Obviously any employment contract is null-and-void that would say you cannot sue in court if you've been raped.

    As the SCOTUS has said, "Citizens can not sign away legally-protected rights," and not being raped is such a right.

    If I was raped, and my contract said I was bound to arbitration, I'd tell tell the corporation to go frak itself, and FILE CHARGES immediately.

    No judge would uphold such a sheitty employment contract.

    Thad - No one is saying the Feds are writing the agreement. No one is saying let's violate your Master's sacred hold on their employees' freedom. All we are saying is if a co has such a restrictive policy, forbid them from federal contracts.

    GOPubes are so out of touch. No real person reads the fine print or understands it if they do. The Govt can help secure people's safety easily.

  • following the logic of Franken's construction / amendment - we should add requirements that robbery and murder are not to be allowed within the fed contract - or add by name every illegal act

    Franken's language was unneeded because rape or slavery or murder or any other criminal act is already subject to OTHER venues of judicial review - that is the point Sen Cochran was making

  • With all due respect, I really don't give a fuck about what Cochran said. By voting no on the Franken amendment he is saying to God and everyone that he is more concerned with KBR/Haliburton, then a women being gang raped. A victim of assault should not have to arbitrate with their employers before they can take their case to an article 3 court. As a matter of fact, the employer should only find out about if they are called in to the case in an article 3 court. Cochran is a pro-rape asshole!

  • well, giving you and your comment all the respect it deserves, and I think you can guess just how much THAT is - there are a myriad of reasons to vote for and against amendments to legislation - Thad gave a cogent and logical reason why he voted no - you are assuming you can read his mind and determine motivations that are not expressed

  • That's bullshit. Thad was saying that the government should not be able to dictate contracts, but if he means that, he could also be saying that OSHA is not something he supports. If a contract involves someone surrendering basic human rights, then damned straight the government should be able to legislate it, and include it in labor and contract law. I for one do not think that the Franken amendment goes far enough. It only covers government contracts. I think that's not enough.

  • a criminal act cannot be enforced through a contractual agreement - Sen Cochran was simply stating that the fed govt should not be in the business of adding additional requirements to fed contracts when judicial review is already available to address this issue

    posit this: why would Sen Franken or any other Member want to add a a requirement to get a fed contract that states slavery is not part of available options in said fed contract - it's because slavery is already illegal

Why should criminals be able to get away with their crimes and the companies who hire them get away with employing these criminals. THANK GOD FOR AL FRANKEN!
