Brainwashing is in fact taken into account when sentences are given, though unfortunately (IMO) it was not so much in Malvo's case. Also, Mohammed has been an adult for a long time and has had the mental capacity to critically look at his actions, while Malvo's self-will was not yet fully developed.

How about I both live in DC and work near the Rockville Courthouse and saw the sniper trial in Maryland, and heard Malvo tell how it happened, heard him give every detail of not only those 6 shootings, but the others. Muhammad offered no defense, no explanation, the evidence was overwhelming and consisted of statements from Muhammad, fingerprints, ballistics, etc. Muhammad's closing consisted of a bunch of nonsense.
The most powerful moment of that trial in Maryland: By far when Malvo said "you made me a monster" to Muhammad when he was cross examining him. I think Malvo's made some good strides in redemption, he has a lifetime in prison to try, not that there's anything he can do to undo the murders. BTW you might want to check your research. Malvo was never sentenced to death, and now he can't be because he was under 17 when the murders took place.
