I'm very concerned about this. I'm writing my own pokemon MMORPG, and have been for years. I was under the impression that if I didn't sell it or make money off it, nintendo would be fine with it. Am I wrong? If so that's very depressing.
@jonsploder Don't waste your time. Make something new. If your clone is any good, it'll be shut down, regardless of money. We sold nothing. We made no money. It was free and libre, open sourced.
@jonsploder To really get under Nintendo's skin, you should make a "Pokemon" MMO....just without the name and assets such as images. It's much harder to claim copyright on movesets and statistics and such (Capcom sued and lost over deliberate Street Fighter clones in the early days). You can copy all the mechanics that make it great...just draw your own pictures and call it something else ;)

@jonsploder the way nintendo works is they did copyright everything including their sprites so if you want to make your own you need to create everything your self including sprites/pokemons and read all their copyrights very well
If you bootleg/pirate a Nintendo game to make money off it. Nintendo's going to shut you down and possible sue you and they have every write to. it's there work your making money off of. how would you feel if I went in your house to steal every game you have ?
@METALMAN4Wii We didn't bootleg or steal anything. We coded the entire project ourselves, the only thing we recycled was the graphics (and the trademarks).
ya know.. u can always play Pokémon Indigo or buy a Nintendo DS and play Pokémon Platinum... cuz u an also play online on Pokémon Platinum with others. (Pokémon Indigo is not better than PokéNet , but it's kinda good.)

Anyway, This is actually the second "Fan-made game" they've shut down (That I'm aware of), the first being a StarFox clone. They also shut down a fan-made zelda movie (The hero of time).
We did what we could. We also promoted the games and had a healthy pokemon fan community around them.
The point is, though, that when I read about Nintendo (I was preparing my own Pokemon clone), I read about all the stuff Nintendo did for IP (Intellectual Property) and hence it was clear to me that Nintendo would not allow any form of infringement. And turns out I was right : (
My game design has now quite much evolved away from pokemon, with the capability of fusing most creatures with each other, real time combat, no fixed movesets, a modified stats system, and more.

If Nintendo could go as low as attacking their own fan games (to a point this means a slap to their fans, who have made a small tribute to their series) they are no one, and their people are miserable. Just what I feel on this.

Even though I stopped going the PN after a point of time due to business elsewhere. I still pay my respects and I feel honored to be part of the community. ~Flare
