It was not murder, murder requires malice aforethought. It was what he was convicted of, involuntary manslaughter. He intended to tase, not shoot, Oscar Grant. Had he allowed himself to be handcuffed we would not be having this discussion. 2) Because there were 2 suspects still unrestrained and Grant was resisting arrest. 3) Several other thugs were encroaching on the scene, refusing officer commands, and one of these thugs attacked an officer and took him to the ground. Add to that a train load of people becoming hostile, tasing Grant was appropriate

You are correct in that Oscar Grant was not handcuffed at the time of the shooting. He was lying face down with another officers knee pressing down on his head or neck. It just looks like he was handcuffed. Why? Because he had his hands behind his back in compliance, waiting to be handcuffed. You can clearly see that his hands are behind his back AFTER he's been shot, then they fall to his side. There was no reason to shoot or tase him.

He was NOT complying with officers orders, he refused to give them his hands. His left arm was underneath his body to keep it from officers, and for all they knew he could have been going for a weapon. Therefore, there absolutely WAS reason to tase him, he was resisting arrest and refusing to give officers his hands.

If this is the view you are talking about,I fully see how you would think that this is Grant's left arm, but it isn't. Between Pirone's legs what you see is the floor. This is pretty clear after Pirone moves his right foot. I started to think you were right about the arm, but upon further inspection it is definitely the floor.

The video shows his right arm very likely was behind his back, you can not tell anything about his left. Grant had assaulted 2 officers. Grant repeatedly stood when ordered to remain seated. Grant refused to give officers his hands, and Grant deserved 100% to be tased. My son would have complied with officers. Hell, my son wouldn't have been fighting on the train.

Even if someone doesn't have enough common sense to know where the taser goes, the police officer still shouldn't have felt the need to bring out a weapon, the victim obviously looked harmless to the officer. He was unarmed and handcuffed and did not physically harm the officer in the first place.
