Sounds like a dusty law dug up from a few 100 years ago. People have been pulling these up for taxes and licenses and on and on. At best you may get a case delayed. Since you quit paying due to false hope. You get raped on fees, fines maybe jail. These laws made sense a long time ago have not been updated. Bottom line new day new laws in the end they win their contract. Sounds too good 2b true 9999.99 X out of 10000 you loose. They can be legal but not moral or ethical. Sad but true

andy- Get legal advice from people who know the law...in this case simply have any good attorney analyze the related contracts. (And in your case, I would add- get grammar and spelling advice from grade school, and common sense from almost anywhere.)

Look at your original mortgage that was recorded with the register of deeds. MERS is most likely the "mortgagee" or "nominee for the lender." If that is the case, it is likely they don't know who owns the mortgage.
Also, if you have been foreclosed on by advertisement by MERS, the foreclosure is VOID--talk to an attorney IMMEDIATELY--in Michigan, this is the case of Residential Funding v. Saurman--there are probably similar cases in other states.

I am currently looking for an attorney in Idaho to file a Complaint to quiet title action, if I can't find one with the balls to go forward I will do the research and file "Pro Per".
