While yes, some departments require you to take off your belt off duty (I don't know of any states where it's a LAW), you generally CANNOT wear anything 'uniform' when off duty - that is anything with a badge or a patch. And almost NO officer that I know of would wear anything uniform without a gun. Too many crazy people who'd love to harm a cop. So also the lack of shoulder patches too are a big clue it's really likely a security guard.
