It's not plagiarism to use common themes prevalent in fiction writing. In a book called How To Read Literature Like a Professor, it said that all stories are just a continuation of another, interrelated, because the all draw on common themes and common backgrounds such as medieval texts and fairytales.

It is like hello, that is one of the most common uses in fiction writing by far. I seen it happen in Lord of the Rings, X-Men, the Wonderful Wizard of Oz, Power Ranger, the Three Musketeers and many more examples. I cannot believe Allen's 'experts' missed that. I would use this information in the lawsuit and see how the opposing lawyers make of it.

...almost all stories have been told, and most people do not have a unique imagination, so the stories in these writer's heads could be identical without them knowing each other. People need to realize that almost all stories have a similar counterpart somewhere in the world. These plagerizing claims are ridiculous. It is actually possible. Willy the wizard was written before harry potter. willy the wizard includes the year of wizards contest ( Goblet of fire ). It also includes wizard trains( Hogwarts Express ), wizard chess, a wizard prison( Askaban ), and a wizards hospital ( St. Mungos. )

As to hospital - Rowling wizard world parallels real world, so it has all the institutions of real world.

I've seen excerpts from the book she was accused of plagiarizing. Apart from being nearly unintelligible, it bears very little resemblance to HP, other than the main character taking a bath. Ludicrous lawsuit, especially when you consider that the book in question didn't even get proper distribution.
