Mortgage insurance does not pay the amount owing on a mortgage when the house owner dies. It insures the mortgage for value if the home owner does not pay. When someone with a mortgage dies the beneficiaries either have to sell that house to get the equity out and pay the bank the money owed or take out a new mortgage in the beneficiaries name to pay out the old mortgage of the deceased. If neither is done the bank has every right to foreclose.

But the long of the short of it is that back in 2008 we had an accidental house fire and lost everything, we tried everything we could to get a modification only to get the run around. You kept his clothes, his car, his TV, all that qualifies you as the "executor of his estate." You're caring for what he used to care for that was owned by him.
You should get a lawyer. Have the lawyer operate as the executor of your sons estate. Your son is next of kin of your husband even if they don't respect your claim, which your lawyer might also state in lawsuit showing as evidence the existent paperwork and whatever he's able to compel BoA produce by court. Definitely this is a lawsuit and you should find a young ambitious lawyer to take this case for you.

Mortgage insurance does not pay the amount owing on a mortgage when the house owner dies. It insures the mortgage for value if the home owner does not pay. When someone with a mortgage dies the beneficiaries either have to sell that house to get the equity out and pay the bank the money owed or take out a new mortgage in the beneficiaries name to pay out the old mortgage of the deceased. If neither is done the bank has every right to foreclose.

But the long of the short of it is that back in 2008 we had an accidental house fire and lost everything, we tried everything we could to get a modification only to get the run around. Here we are in 2012 still fighting to stay in our home that we had rebuilt. It's a mess!

In my entire life, I've never heard of making contractual adjustments without both parties signing off, literally. In Florida (if that's where you live) you could end up with massive punitive damages if not criminal fraud charges against the bank officers responsible with the right District Attorney looking for re-election.

A lot of law firms will do work pro bono if they feel strongly sympathetic about your case. Pro bono is the legal term used to describe professional work voluntarily undertaken for free or at a steep discount in service to the public. Try talking to several lawyers. One of them might take your case pro bono and help you straighten things out. Be persistent :)

Lawyers usually charge hundreds of dollars per hour & unless she feels like going deep into debt for a case that has too much going against her, it's a really dumb thing to do. The only thing she might have going for her is that if her son is his, she can get Social Security payments for him until he is 18.

@kerry5101971 Happily moved on from what? He beat me, should I have stayed? He killed himself, after trying to shoot both me and our son first. Huffington Post only told part of the story. I have his only minor child, who is entitled to everything his father owned. As for gettting everything in writing, I was able to get everything else- no problem. Only BOA has given me any issues. Why would he remove me from anything? Whether he is here or not, our son still has to be provided for.

A question: How could they change a fixed rate mortgage to an adjustable rate mortgage legally? How do they change the terms of a loan that they signed to? Mortgage insurance is for those who cannot make at least 15% down payment. Take them to court; challenge them on the mortgage, they probably dont have it. @DAngelo136 It wasnt literally an adjustable rate mortgage. month to month, the rate would change, despite the fact it was fixed rate. BOA would add a product without us knowing, we would call, and they would promise to readjust our account, with late fees of course, even though we paid the same amount, as per our contract, every month. BOA always found a way to add a mortgage product on without our consent. our mortgage increased over 250-300 over the course of 2.5 years and it was never should

@entriguecharles I'm sure they did all that. Have you consulted legal counsel? How do they legally change the terms of a loan without consent? The chances are they your mortgage has been securitized and sold off. If that is the case, they cannot foreclose on a mortgage they do not hold. They did the same thing in Florida, I believe and the courts have stopped the forclosure process in many homes. The bottom line is that when they "add" a product they are amending the terms of

As your husband is deceased (my sympathies) and you probably have not signed it, I can't see how it can stand up in court. I would urge you to seek legal counsel and force the bank to prove that it has followed the law before they foreclose on your home.

It's possible your boyfriend killed himself because he didn't want to loose the home and put you and your son through homelessness. I don't know if he was having money problems, but that might have been 1 reason he did what he did. BoA imposed that on him, that he be faced with that choice. If they hadn't broken your contract and put insurance on it, it would never have occurred to him.

I had a possible mini-stroke once on the phone with them. I was in such a confused state and also in such an economic hole that I refused to be taken to the hospital due to our high deductible. In addition to suing them for the property, you should sue them for damages on their previously increasing the monthly payment without negotiating with you and defiling the finalization of the contract that was previously established. You might sue them for contributing to the loss of your babys dad, on account of their having put that option to him to support his baby financially by death. That might have been a factor in your boyfriends psychology that drove him to kill himself, home insurance

They should have defined for you who the "executor of his estate" was to find out who was caring for his stuff. You should get a lawyer. Have the lawyer operate as the executor of your sons estate. Your son is next of kin of your husband even if they don't respect your claim, which your lawyer might also state in lawsuit showing as evidence the existent paperwork and whatever he's able to compel BoA produce by court. Definitely this is a lawsuit and you should find a young ambitious lawyer to take this case for you.
