I'm not completely certain (I don't live in the States) but I think that, because the ad is made by a 3rd party, it cannot be funded by the candidate whose standing is intended to benefit from it and still purport to be the product of an independent group. I may be mistaken, though.

it is illegal to coordinate with another group. they're known as 527's and aren't constrained by the same fundraising restrictions. Presidential candidates can only receive $2300 max from a person. these 527 groups can raise anything so its a matter of keeping to the limits.
