Okay here's what I get out of this whole ordeal. In my opinion:
You're right about how much yard space you can use (the contract is vague), and that rent is due because the 6 months paid upfront are done.
Chris is right about you using the shop far beyond the scope of the contract, using his tools without permission, breaking and losing said tools, double-renting, and that he should be compensated for his damaged property and the double rent paid to you by the construction company.
when the issue of the tools came up, instead of doing lunch meetings i woud have gone to crappy tire and bought the big socket set that was on sale that week, and got two, one for pug and one for my worker that got caught in the x fire to use for work. $160 bucks or so for 2 sets, and saved some lawyer time and risk having no tennant income.

Not to have people work in the shop when the renter is not present. Nor use the renters tools that i seen. Post A link on that specific tenant agreement so I can read the whole thing. So i may make A video of it and point out both sides of discretion.

you guys have failed to set in writing the prescribed limits to which the use of the compound, shop and storage area shall be used. Not having limits set in writing allows you to walk all over pug like a hired hand. "the tenant may permit the landlord..." this means that you must ask pug for permission to open the shop of compound every time you wish to enter the premises! so friggin chooch It!

I am a residential LL so my knowledge of commercial rental is limited, I know the L has a lot more right's when it comes to commercial (which is why I want to get into commercial instead of residential).

I'm not a lawyer, but I have a MBA and am familiar with contracts. It looks like the lease is pretty straight forward regarding your rights as a landlord except for a few things. What is your responsibility with regard to snow removal? Is there a portion of the lease that allows you to use Pug's tools or is that a verbal agreement? It appears that the tenant may not have read the lease agreement as closely as he should have which is usually the case in disputes like this.

If I'm reading it right, the highlighted section at 1:46 says you or someone you authorize can inspect the building periodically, not use it as though you're not renting it out regularly.
The lease agreement is vague about how much of the compound you've set aside for your own use, but if you're going to use half of the lot and still charge the tenant full rent for it, that's a pretty goofy thing to do, man. (Esp. if you're subletting another chunk and pocketing the money, on top of the rent)

@lscb5105 He probably wont get far with that - for a start in this video he has highlighted "you are permitted to enter the premises to "EXAMINE' the condition of the and "VIEW" the state of repair". Since when does that give the right to go in the shop, use it as well as using the tenants tools etc? There are videos showing andy using the shop (ie replacing the cab on the truck). I would be pissed also if a landord thought it was ok to come and use the shop and go as he pleases.

you guys have failed to set in writing the prescribed limits to which the use of the compound, shop and storage area shall be used. Not having limits set in writing allows you to walk all over pug like a hired hand. "the tenant may permit the landlord..." this means that you must ask pug for permission to open the shop of compound every time you wish to enter the premises! so friggin chooch It!

Seems like pug has a problem with everybody who doesn't agree with him. So far I haven't seen him making anything productive at his shop. (except bams scrap-metal-corner) I've only watched incomming orders from Andy on video so far - (and Ray ofcourse)
That said, you'll have to respect his tools & shit - on that issue I totally agree with Pug. Plus accessing the shop without pugs knowledge is also wrong

Holt shit, after reading the rest of what you showed I definitely need to be a commercial LL and dump my residential property.
The tenant pays the tax & insurance, the tenant has to make repairs on the building.
If the tenant misses rent, they owe the next 3 month's rent up front!
Are these things in the code or are they your specific lease?
And lastly, you shouldn't highlight anything as the highlighter will eat the ink over time.

I am a residential LL so my knowledge of commercial rental is limited, I know the L has a lot more right's when it comes to commercial (which is why I want to get into commercial instead of residential).
It says you are allowed to use parts of the shop for storage, not work on your shit, use the Tenants tools and equipment. I believe you are in violation when you are doing so.
Also, I assume you have to give 24hrs notice before entering the building?

I'm not a lawyer, but I have a MBA and am familiar with contracts. It looks like the lease is pretty straight forward regarding your rights as a landlord except for a few things. What is your responsibility with regard to snow removal? Is there a portion of the lease that allows you to use Pug's tools or is that a verbal agreement? It appears that the tenant may not have read the lease agreement as closely as he should have which is usually the case in disputes like this.

Andy the part about terminating the lease is not valid it must state the land lord has the right to terminate this leas and renter the premises apon service the tenant with a 30 day notice to vacate to wit.
with out this you might lose in court.
i would strongly suggest you take the shown lease and have a lawyer that deals with tennan land lord leases:)

@bozzza69 Unfortunately if you read the lease Pug Signed it is in favor of the Landlord.
The only thing I see that Andy did wrong was use the shop and Pugs tools without Pugs Permission. The rest of the lease allows Andy to do what he has been doing.

The limited storage is "up top", whatever that is.... (I would guess it's an upper floor of storage area in the shop)

If I'm reading it right, the highlighted section at 1:46 says you or someone you authorize can inspect the building periodically, not use it as though you're not renting it out regularly.
The lease agreement is vague about how much of the compound you've set aside for your own use, but if you're going to use half of the lot and still charge the tenant full rent for it, that's a pretty goofy thing to do, man. (Esp. if you're subletting another chunk and pocketing the money, on top of the rent)

If Chris is lease/renting the building and lot from you, then by all means the space the city is renting should be paid to Chris.
The access to the building sure is misinterpreted by the landlord as well. Access to the building for inspection and repairs, not to use at your disposal, especially if Chris is paying utilities.
Not to mention tools. Whoa buddy, if my tools were molested like that, whoever was responsible would pay with their hide.
His tools are obviously his livelihood.
