This question doesn't apply to 1938 Germany, because by then most Germans supported the Nazis, and they were in power, thus the question of prosecutions was not even on the table to start with. It's not just in the US but across the world. Here in the UK we've got the same problem of governments seemingly for the people, but screwing them over every chance they get. To be honest George Orwell had it spot on in 1984 that the Elite's aim is to disenfranchise the middle class, the only class viewed as a threat to the Elite, and keep the poor so poor that they haven't got time to be educated and organised.
