  • EWWW not the ACLU, they want to force gay leaders into a CHRISTIAN private organization where kids on field trips.

    ACLU isnt the smartest thing, im not a fan of them. Although yea this kids rights were infrigned.

  • @MrSour07 The ACLU takes cases such as this pro bono i.e. for free so no he's not a rich white person trying to make a point. I further more think your comment is racist but like this white kid and his attorney i support your right to make such comments.

  • Unfortunately unlike Tinker the speech here was not political or religious, but within the opinion of the court at best ridiculous and at worst promotes illegal drug use which is against school and public policy.

  • Free speech is limited only by sedition, slander, deception and revealing troop movements. That's it. Oh yeah, one more. If you are a US citizen, deemed a terrorist, denied a trial and targeted by the CIA for extermination. Nearly forgot that one.

  • I have the right to visit the bronx in LA or any where, with a sign that says "I HATE (race goes here)". Its the country as a whole that needs to start policing them selves. All we are doing is just junking up our constitution and pissing people off. No wonder why we are really worried about being nuked right now.

  • The citizens of the U.S. already police themselves through the use of free speech. What we do not want is Government Speech Police. No non-governmental entity is responsible for the threat of possible nuclear attack. This threat is directly linked to foreign policy. Do you want a foreign military base built in your holyland of Idaho? :) The Patriot Act and absolute abuse of power is "junking up" the U.S. Constitution, not a citizen exercising her or his rights.   • A student at our school (LCSC in ID) decided to talk about how he would execute his own Virginia Tech. NO NO NO! He was really surprised when we had him arrested and put him in a mental hospital. He was released following a mental eval., but our Dean Thomas Banned him from campus grounds forever. That how we handle that speech BS in Idaho.

  • As much as I'd love for this kid to lose this case He legally shouldn't He wasn't @ school that day and wasn't on school grounds as well as it being after they released class therefore not subject to their rules However I don't feel he should win based on free speech People shouldn't be able to just say WHATEVER they want, and even though he just wanted to get on tv. It still promotes drug use If he wins, students will be able to say whatever theywant and teachers will be 2 afraid 2 punish them

  • @thequietkid10 Actually the term 'free speed' DOES entitle a person to say whatever they want. However if one were to say something that others find offensive, then that individual runs the risk of possibly having to deal with a confrontation.

I don't get how society applauds a high schooler for promoting pot. Society has become demented. What if that was your teenager. Would you say, "Right on my boy." I doubt it.

  • You would be jailed, and legally so, for suggesting that you are going to commit an illegal act. The phrases 'Bong Hits 4 Jesus' and 'Kill people for Christ' do not compare to one another. Nothing illegal was being advocated by Fredrick. You, and not the ACLU, are a joke for not knowing your own First Amendment.

  • Does someone have the right to hold a sign that says, "Rape A Woman or Molest a child." Smoking pot maynot be as drastic but it is illegal, it is a crime, and this kid was promoting a crime. The message to smoke pot to High Schoolers is just as dangerous as bringing a Budweiser Sign to AA. That which causes someone danger is no longer a right. This guy is not protected. Watch and see.

  • you have to do a little research first. He is completely legal as long as it doesn't disrupt the school and its ways. It didn't affect it at all, so he is completely protected.

  • The ACLU attorneys are a joke. These are the same guys who are defending terrorist because they have the right to say, "Let's kill americans." This Joe guy should be arrested for promoting a crime. He is telling people to smoke pot.  Forget about the student stuff, or school stuff, think about the crime aspect of it. If I held a banner that said, "KILL .... people for Christ." I would deserve to be jailed. This guy is a joke and ACLU is a joke.

    Actually the First Amendment DOES protect your right to advocate an illegal act "except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action." See Brandenburg v Ohio

    This current case does not even clearly involve the advocacy of illegal action. The case is more about whether full free speech rights apply to non-disruptive student speech off school grounds at a school sanctioned activity

  • You wouldnt be the first one to say "kill people for Christ" And killing people and smoking pot is like comparing apples to oranges, dont you think? Its more like saying "Steal stuff and give it to the poor for Christ" or "Dont go to work and expect to be paid."
